ORDINANCE 24-1607 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, <br />AMENDING PART III, UNIFIED LAND DEVELOPMENT <br />REGULATIONS, CHAPTER II, DISTRICT AND GENERAL <br />REGULATIONS, ARTICLE V, ZONING DISTRICT REGULATIONS, <br />SECTION 2-5.3, LAND USE BY DISTRICT TO ALLOW MEDICAL <br />SERVICES IN THE OR (OFFICE• -RESIDENTIAL) ZONING DISTRICT <br />AND TO REMOVE THE REQUIRED CONDITIONAL USE APPROVAL <br />TO ALLOW ALCOHOL SALES FOR ON-SITE CONSUMPTION IN <br />APPLICABLE COMMERCIAL AND PLANNED MIXED USE ZONING <br />DISTRICTS; AND AMENDING CHAPTER V, GLOSSARY, ARTICLE <br />XXI, LANGUAGE AND DEFINITIONS, SECTION 5-21.2, DEFINITION OF <br />TERMS, TO REFINE THE DEFINITION OF VETERINARY MEDICAL <br />SERVICES; PROVIDING FOR VESTING OF RIGHTS, CODIFICATION, <br />CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. <br />WHEREAS, the City of Casselberry ("'City") maintains the Unified Land Development <br />Regulations (ULDR) meant to assist in the implementation of the City's Comprehensive Plan by <br />providing standards for the use and design of real property within the City; and <br />WHEREAS, the ULDR also includes the City's zoning district regulations, which may <br />be amended from time to time; and <br />WHEREAS, in 2022, the City amended ULDR Section 2-5.3 via Ordinance 22-1573 and <br />inadvertently removed medical services as a permitted land use in the OR (Office -Residential) <br />zoning district, thereby creating an influx of non -conforming uses and undue burden on existing <br />businesses; and <br />WHEREAS, Ordinance 22-1573 also amended ULDR Section 5-21.2 to include a <br />definition for Veterinary medical services but expressly excluded typical pet -related services such <br />as boarding, daycare, grooming, and training; and <br />WHEREAS, the ULDR presently requires conditional use approval for sales of alcohol <br />for onsite consumption from the City's Planning and Zoning Commission in addition to Florida's <br />Department of Business and Professional Regulation's strict licensing requirements and the <br />City's comprehensive zoning evaluation when reviewing business tax receipt applications, <br />which has caused delays in local business operations; and <br />WHEREAS, the City desires to correct these inconsistencies and refine existing <br />regulations to remove unnecessary barriers for the benefit of the community's economic <br />development activities; and <br />WHEREAS, Exhibit "A" Amendments to Table 2-5.3 Land Use by District identified in <br />this Ordinance, are incorporated herein by reference and made a part hereof of this Ordinance; and <br />WHEREAS, the proposed amendments to the ULDRs are consistent with the City's <br />Comprehensive Plan and State of Florida Growth Management Act; and <br />
