Installation testing, and maintenance of protective <br />devices shall be conducted by certified personnel approved by the City's Public Works &Utilities <br />Department. The non-residential consumer shall notify the City's Public Works &Utilities <br />Department at least 48 hours in advance, in writing when the tests are to be undertaken so that a <br />representative is present as a witness if the City so desires. The consumer shall keep records on <br />their testing, maintenance, and repair activities related to cross connection control and shall make <br />these records available upon request. Copies of all testing, maintenance, and repair records shall <br />be sent to the City's Public Works & Utilities Department immediately after the work is performed <br />City shall be responsible for testing of backflowpreventers required for all properties subiect <br />to the residential cross connection control program. All residential properties with backflow <br />preventers attached to the potable water system shall be required to participate in this program and <br />are subject to associated fees or charges established by the City. The owner of any property subject <br />to this program shall ensure that the device is accessible to the representatives of the City for the <br />purposes stated herein. _Failure to provide access to the device shall be cause for discontinuing <br />potable water service until access to the device is resolved to the satisfaction of the C4Y. If Cit <br />testing determines insufficiencies for the protection devices from testing the owner will be notified <br />of the deficiencies and will be required to fix the issues within 30 days from notice. The owner <br />will also be responsible for the retest required from anv deficiencies found. The City will not be <br />responsible for maintenance and repairs to cross connection control devices The City will also not <br />be responsible for the testing of non-residential cross connection control devices. <br />SECTION VI. CODIFICATION. It is the intention of the City Commission of the City <br />of Casselberry, Florida, and it is hereby ordained that the provisions of this Ordinance shall become <br />and be made a part of the Code of Ordinances of the City of Casselberry, Florida; that the Sections <br />of this Ordinance may be renumbered or re -lettered to accomplish such intention; that the word, <br />"Ordinance" may be changed to "Section," "Article," or other appropriate word. <br />SECTION VII. CONFLICTS. All Ordinances or Resolutions, or parts of Ordinances or <br />Resolutions in conflict with any provisions of this Ordinance are hereby repealed to the extent of <br />the conflict. <br />SECTION VIII. SEVERABILITY. If any Section or portion of a Section of this <br />Ordinance proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or <br />impair the validity, force, or effect of any other Section or part of this Ordinance. <br />Ordinance 2024-1608 <br />Page 5 of 6 <br />
