SECTION III. AMENDING SEC. 86-267. Section 86-267, "Property access for cross connection control," of Chapter 86, Utilities, Article III, Division 7 — Cross Connection Control of the Code of Ordinances of the City of Casselberry, Florida, is hereby amended as follows: Sec. 86-267. Property access for cross connection control. Duly authorized employees of the City bearing proper credentials and identification, with the consent of the owner/occupant, shall be permitted to enter any building, structure or property served by a connection to the public potable water supply system of the City for the purpose of inspecting the piping system or systems on such property. Consent to such access shall be obtained from a person 4-518 years of age or older in control thereof. If such consent is refused, the City may obtain an inspection warrant pursuant to F.S. § 933.21. SECTION IV. AMENDING SEC. 86-268. Section 86-268 "Discontinued Service," of Chapter 86, Utilities, Article III, Division 7 — Cross Connection Control of the Code of Ordinances of the City of Casselberry, Florida, is hereby amended as follows: Sec. 86-268. Discontinued service. No water service connection shall be installed or maintained by the City unless the consumer is in compliance with the requirements of the cross connection control manual. Service of water to any premises shall be disconnected if a backflow prevention device is not installed, tested and maintained or if an unprotected cross connection exists on the premises. Notice shall be given to the consumer prior to discontinuing service except where, in the judgment of the Director- of Public- WorksPublic Works &Utilities Director or his or her designee, the threat to public health is such that action must be taken immediately. SECTION V. AMENDING SEC. 86-270. Section 86-270, "Expenses and records," of Chapter 86, Utilities, Article III, Division 7 — Cross Connection Control of the Code of Ordinances of the City of Casselberry, Florida, is hereby amended as follows: Sec. 86-270. Expenses and r-eeords.Customer Responsibilities and City Responsibilities TheconsumerResidential Consumers shall bear all expenses of installing,, testing and maintaining the protection devices required by the cross connection control manual to ensure proper operation on a continuing basis. Installation,testing and maintenance of protective devices shall be conducted by certified personnel approved by the City's Public Works & Utilities Department. If the back flow prevention device fails testing the owner will be notified of the deficiencies and will be required to fix the issues within 30 days from notice at owner's expense The owner will also be responsible for any retests necessary after a deficiency is determined. T-1,te eonsunief shall notify the City's Public Works Department -At least 48 hours in advance, in writing.j when the tests are to be undei4aken so that a representative is present as a witness if the City so desires. The consumer shall keep records on his testing maintenance and repair activities related to cross connection control and shall make these records available upon request. Copies of all testing maintenance and repair records shall be sent to the City's Public Works & Utilities Department immediately after the work is performed. Non-residential (commercial and industrial) consumers shall bear all expenses of installing testing, and maintaining the protection devices required by the cross connection control manual to Ordinance 2024-1608 Page 4 of 6
