Code Enforcement Hearing <br />Minutes, August 15, 2024 <br />Page 3 <br />Staff Presentation: Tyler Hall, Code Compliance Officer advised that the above cases were in compliance <br />and would not be heard. No Further action was taken. <br />NEW CASE <br />D. CE -24-001349: 225 Lake Ellen Drive <br />Violations — City Code 1-4.3 No Building Permit. <br />Staff Presentation: Tyler Hall, Code Compliance Officer gave testimony for case CE -24-001349, located <br />at 225 Lake Ellen Drive. The property was reinspected and found to remain in violation on August 12, <br />2024. The City requested a correction date of August 29, 2024. If there is no compliance by August 15, <br />2024, then a fine of $50.00 per day should then be imposed for each day of non-compliance thereafter. The <br />City requested a subsequent hearing date of September 19, 2024, to determine compliance. There was a <br />representative present to speak about this case. <br />Discussion: Valentina Vakhova. 225 Lake Ellen Drive stated that she realized too late that she could not <br />just enclose the two walls, when Tyler Hall and Ray McHugh advised that a permit was needed. It had also <br />taken time to get the right people to get the permit. Officer. Hall stated that there were things needed to <br />obtain the permit and that the City was willing to give a reasonable amount of time for an extension. Ms. <br />Vakhova asked for an extension to November 2024. Mr. Hall stated the City was okay with November 18, <br />2024, for a compliance date. <br />Special Magistrate Ruling: A ruling was made by the Special Magistrate that case CE -24-001349, located <br />at 225 Lake Ellen Drive and was found in violation of City Code 1-4.3 and if there is no compliance a <br />$150.00 per day fine will be imposed. The Respondent was given until November 18, 2024, to achieve <br />compliance. A subsequent hearing well be held on November 21, 2024, to determine if compliance has <br />been achieved. <br />OTHER BUSINESS <br />There was no other business. <br />ADJOURNMENT <br />The Special Magistrate adjourned the meeting at 6:53 p.m. <br />DATE MINUTES APPROVED BY SPECIAL MAGISTRATE <br />Michael D.
