CASSELBERRY CITY COMMISSION <br />Minutes of August 26, 2024 — Regular Meeting <br />Page 7 of 15 <br />Budget Impact: There is no impact on the City's budget. <br />Recommendation: The City Manager and the Community Development Director recommended approval <br />of Ordinance 24-1606 on first reading. <br />Audience Participation: No one came forward to address Ordinance 24-1606. <br />MOTION: Commissioner Divita moved to approve Ordinance 24-1606 on first reading, <br />as presented. Motion was seconded by Commissioner Busch. Motion carried <br />unanimously by voice vote 4-0. <br />B. First Reading of Ordinance 24-1607 — Regulation of Medical Services, Alcohol <br />Sales for Onsite Consumption, and Veterinary and Pet -Related Services <br />The City Clerk read Ordinance 24-1607 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING PART III, <br />UNIFIED LAND DEVELOPMENT REGULATIONS, CHAPTER II, DISTRICT AND GENERAL <br />REGULATIONS, ARTICLE V, ZONING DISTRICT REGULATIONS, SECTION 2-5.3, LAND <br />USE BY DISTRICT TO ALLOW MEDICAL SERVICES IN THE OR (OFFICE -RESIDENTIAL) <br />ZONING DISTRICT AND TO REMOVE THE REQUIRED CONDITIONAL USE APPROVAL <br />TO ALLOW ALCOHOL SALES FOR ON-SITE CONSUMPTION IN APPLICABLE <br />COMMERCIAL AND PLANNED MIXED USE ZONING DISTRICTS; AND AMENDING <br />CHAPTER V, GLOSSARY, ARTICLE XXI, LANGUAGE AND DEFINITIONS, SECTION 5-21.2, <br />DEFINITION OF TERMS, TO REFINE THE DEFINITION OF VETERINARY MEDICAL <br />SERVICES; PROVDING FOR VESTING OF RIGHTS, CODIFICATION, CONFLICTS, <br />SEVERABILITY, AND AN EFFECTIVE DATE." <br />Staff Presentation: Chief Planner Antonia DeJesus stated that approval of Ordinance 24-1607 amending <br />the City's Unified Land Development Regulations relating to the regulation of Medical Services, Alcohol <br />Sales for Onsite Consumption, and Veterinary and Pet -Related Services is requested. The City's Planning <br />and Zoning Commission, acting as the City's Land Planning Agency (LPA) voted unanimously 7-0 at its <br />meeting on August 14, 2024 to recommend approval of Ordinance 24-1607 to the City Commission. The <br />City's ULDR (Unified Land Development Regulations) is meant to assist in the implementation of the <br />City's Comprehensive Plan by providing standards for the use and design of real property within the City <br />and also includes the City's zoning district regulations. The proposed amendment aims to amend ULDR <br />Section 2-5.3, Land Use by District to a) allow Medical Services in the OR (Office -Residential) Zoning <br />District and b) remove the required Conditional Use Approval to allow Alcohol Sales for On -Site <br />Consumption in applicable Commercial and Planned Mixed Use Zoning Districts; and to amend ULDR <br />Section 5-21.2, Definition of Terms to refine the definition of Veterinary Medical Services. Ms. DeJesus <br />stated it was important to note that it was not being proposed to change where alcohol is allowed to be <br />served or consumed, but only to remove the conditional use requirement. In 2022 the City Commission <br />adopted Ordinance 22-1573 which specifically dealt with land use and the land use table. The ordinance <br />inadvertently removed Medical Services as a permissible use in the OR (Office -Residential) zoning district, <br />which rendered a lot of businesses as non -conforming, which meant that once that use stopped, after 90 <br />days another medical office would not be allowed to move into that same location.
