CASSELBERRY CITY COMMISSION <br />Minutes of August 26, 2024 — Regular Meeting <br />Page 4 of 15 <br />MN-2873-RMG, RELATING TO PFAS CONTAMINATION OF DRINKING WATER; <br />AUTHORIZING THE CITY MANAGER TO COMPLETE ALL DOCUMENTATION AND <br />EXECUTE ALL RELEASES AND AGREEMENTS NECESSARY TO PARTICIPATE IN THE <br />SETTLEMENT WITH TYCO AND BASF CORPORATION IN THE WATER PROVIDERS' <br />PORTION OF THE MDL; AND AUTHORIZING OUTSIDE COUNSEL TO CONTINUE TO <br />PURSUE LITIGATION RELATED TO PFAS; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND AN EFFECTIVE DATE." <br />Introduction: Approval of Resolution 24-3452 authorizing participation by the City of Casselberry in <br />settlement processes with Tyco Fire Products LP and BASF Corporation relating to a possible contaminant <br />known as PFAS; delegating authority to the City Manager to execute related claims documents, releases, <br />and agreements necessary to participate in the settlement processes; and authorizing outside counsel to <br />continue to pursue litigation related to PFAS is requested. <br />Budget Impact: There is no budget impact anticipated at this time. <br />Recommendation: The City Manager, the City Attorney and the Public Works & Utilities Director <br />recommended approval of Resolution 24-3452. <br />Audience Participation: No one came forward to address the Consent Agenda. <br />MOTION: Vice Mayor Aramendia moved to approve the Consent Agenda, as presented. <br />Motion was seconded by Commissioner Busch. Motion carried unanimously by <br />voice vote 4-0. <br />8. DISCUSSION ITEMS <br />A. Future Agenda Items <br />No items were presented for consideration. <br />9. RESOLUTIONS <br />A. Resolution 24-3453 — Appointing Kristin Eick of Garganese, Weiss, D'A reg sta & <br />Salzman, P.A. as City Attorney <br />The City Clerk read Resolution 24-3453 by title, as follows: <br />"A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, <br />FLORIDA, APPOINTING KRISTIN EICK OF GARGANESE, WEISS, WAGRESTA & <br />SALZMAN, P.A. AS PRIMARY CITY ATTORNEY; AUTHORIZING AN ENGAGEMENT <br />AGREEMENT FOR LEGAL SERVICES; AND PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND AN EFFECTIVE DATE." <br />
