Public Hearing: Second Reading of Ordinance 24-1604 — Amending Section 9 Effective Date of Charter Amendments of Ordinance 23-1590 The Deputy City Clerk read Ordinance 24-1604 by title, as follows: "AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING SECTION 9, EFFECTIVE DATE OF CHARTER AMENDMENTS, OF ORDINANCE 23-1590 TO PROVIDE ALL APPROVED CHARTER AMENDMENTS APPLY TO THE AUGUST 20, 2024 ELECTION; PROVIDING FOR CONFLICTS, SEVERABILITY, EFFECTIVE DATE OF ORDINANCE AND AN EFFECTIVE DATE FOR THE APPROVED AMENDMENTS." Notice of Public Hearing: The Notice of Public Hearing relative to second reading of Ordinance 24-1604 was advertised in the Orlando Sentinel on Friday, July 12, 2024. Business Impact Statement: A Business Impact Statement was provided for this ordinance in accordance with Section 166.04] (4), Florida Statutes. Staff Presentation: City Attorney Catherine D. Reischmann stated that adoption of Ordinance 24-1604 amending Section 9, Effective Date of Charter Amendments of Ordinance 23-1590 to state that all Charter Amendments, if approved by the electors on August 20, 2024, apply to the August 20, 2024 Election, is requested. She then gave a brief overview of the ordinance, explaining that the purpose was to clarify language in the previously adopted ordinance which approved the ballot questions, to make very clear that any amendments approved by the voters would take effect immediately and would apply to the August 20"' election and all elections moving forward. She used as an example the proposed amendment to eliminate the runoff election, stating that if it was passed by the voters, there would be no runoff election as a result of votes case in the August 20"' election. In response to a question from the Commission regarding how the election was certified, Ms. Reischmann explained that the election results were certified as a whole for both the candidates and the amendments, She noted that there was a precedent for this type of thing related to charter amendments, and she had researched how other cities had handled similar situations, and she believed the ordinance language clarified the process and there would not be any issues. Budget Impact: There is no impact to the City Budget. Recommendation: The City Manager, the City Attorney, and the City Clerk recommended adoption of Ordinance 24-1604 on second and final reading. Public Hearing: Mayor Henson stated this was a public hearing to hear and consider comments and questions regarding Ordinance 24-1604. Mayor Henson opened the floor for public participation. No one came forward to address Ordinance 24-1604. Mayor Henson closed the public hearing relative to Ordinance 24-1604. MOTION: Commissioner Divita moved to adopt Ordinance 24-1604 on second and final
