CASSELBERRY CITY COMMISSION <br />Minutes of July 22, 2024 — Rcgular Meeting <br />Pagc 14 of 18 <br />11. PUBLIC HEARINGS <br />A. Public Hearing: Second Reading of Ordinance 24-1604 — Amending Section 9 <br />Effective Date of Charter Amendments of Ordinance 23-1590 <br />The Deputy City Clerk read Ordinance 24-1604 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING SECTION 9, <br />EFFECTIVE DATE OF CHARTER AMENDMENTS, OF ORDINANCE 23-1590 TO PROVIDE <br />ALL APPROVED CHARTER AMENDMENTS APPLY TO THE AUGUST 20, 2024 ELECTION; <br />PROVIDING FOR CONFLICTS, SEVERABILITY, EFFECTIVE DATE OF ORDINANCE AND <br />AN EFFECTIVE DATE FOR THE APPROVED AMENDMENTS." <br />Notice of Public Hearing: The Notice of Public Hearing relative to second reading of Ordinance 24-1604 <br />was advertised in the Orlando Sentinel on Friday, July 12, 2024. <br />Business Impact Statement: A Business Impact Statement was provided for this ordinance in accordance <br />with Section 166.04] (4), Florida Statutes. <br />Staff Presentation: City Attorney Catherine D. Reischmann stated that adoption of Ordinance 24-1604 <br />amending Section 9, Effective Date of Charter Amendments of Ordinance 23-1590 to state that all Charter <br />Amendments, if approved by the electors on August 20, 2024, apply to the August 20, 2024 Election, is <br />requested. She then gave a brief overview of the ordinance, explaining that the purpose was to clarify <br />language in the previously adopted ordinance which approved the ballot questions, to make very clear that <br />any amendments approved by the voters would take effect immediately and would apply to the August 20"' <br />election and all elections moving forward. She used as an example the proposed amendment to eliminate <br />the runoff election, stating that if it was passed by the voters, there would be no runoff election as a result <br />of votes case in the August 20"' election. In response to a question from the Commission regarding how the <br />election was certified, Ms. Reischmann explained that the election results were certified as a whole for both <br />the candidates and the amendments, She noted that there was a precedent for this type of thing related to <br />charter amendments, and she had researched how other cities had handled similar situations, and she <br />believed the ordinance language clarified the process and there would not be any issues. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager, the City Attorney, and the City Clerk recommended adoption of <br />Ordinance 24-1604 on second and final reading. <br />Public Hearing: Mayor Henson stated this was a public hearing to hear and consider comments and <br />questions regarding Ordinance 24-1604. Mayor Henson opened the floor for public participation. No one <br />came forward to address Ordinance 24-1604. Mayor Henson closed the public hearing relative to <br />Ordinance 24-1604. <br />MOTION: Commissioner Divita moved to adopt Ordinance 24-1604 on second and final <br />
