In addition to other terms defined herein, the following definitions are used in this <br />Agreement: <br />A. City System — the water system owned and operated by City and used to provide <br />water to the Property. <br />B. Utility Improvements — New potable water lines, valves, and other potable water <br />appurtenances to be constructed along Lake Howell Road and the Property that are <br />necessary to relocate the water meter and provide potable water to the Property <br />from the City System along the Lake Howell Road right of way. <br />2. Owner acknowledges and agrees that connecting the Property to the City System will <br />require installation by the City and maintenance by the Owner of Utility Improvements on <br />the Property. <br />3. City agrees to install the Utility hnprovements in compliance with current City standards <br />and all applicable governmental laws, rules and regulations at City's cost. <br />3.1. Such installation shall commence after the execution of this Agreement and shall <br />be accomplished with due diligence. <br />3.2. City will connect the Utility Improvements to the City System at the City's own <br />cost. <br />4. The Owner hereby: <br />4.1. Grants permission to City, its agents, employees and independent contractors to <br />enter the Property in order to construct and install the Utility Improvements. <br />4.2. Grants to City, its agents, employees and independent contractors, a temporary <br />construction easement over, under, across and on the Property to allow City to <br />engage in the activities set forth in paragraph 4. 1, and all related activities. This <br />easement is temporary and will terminate upon completion of construction. Other <br />than the termination of the temporary easement, this Agreement will remain valid <br />and binding in all other respects post construction. <br />Upon completion of installation of the Utility Improvements: <br />5.1. City shall restore all disturbed areas to the condition the disturbed areas existed <br />immediately prior to the Utility Improvements installation. <br />5.2. In the event that City was required to make a cut in any sidewalk, driveway or other <br />paved area on the Property in order to install the Utility Improvements, City shall <br />resurface the cut area in accordance with applicable Utility Standards. <br />6. After the expiration of two years after completion, or after termination of the Warranty <br />Bond from the City's contractor guaranteeing the construction involved in the installation <br />of the Utility Improvements: <br />2 <br />
