Owner owns the real property (the "Property"), in Seminole County, Florida, described on <br />the attached Exhibit A, located at 836 Lake Howell Road, Maitland, Florida 32751. <br />B. City acknowledges that Owner has a need for a utility system to service the Property in the <br />form of the Utility Improvements described below. <br />C. Owner acknowledges that: <br />1). The old water service line has the potential to contribute lead to the Property's water <br />system. As a public service due to the fact that the Owner operates a school for <br />young children on the Property, the City will replace the old service line as a <br />precaution. <br />2). The Utility Improvements will be beneficial to the Property. <br />3). The Utility Improvements on the Property must be maintained by the Owner. <br />4). Owner is in no way indicating that it is aware of lead pipe issues or that there is <br />lead in the School's water system. <br />NOW, THEREFORE, in consideration of the mutual undertakings and agreements herein <br />contained, and other good and valuable consideration, whose receipt and adequacy are hereby <br />acknowledged, Owner and City hereby covenant and agree as follows: <br />
