WHEREAS, after said public hearing, the City Commission of the City of Casselberry, <br />Florida, determined that the requested amendment is consistent with the City's Comprehensive <br />Plan FLUM and is in compliance with all applicable procedures of the Unified Land Development <br />Regulations, Code of Ordinances of the City of Casselberry, Florida; and <br />WHEREAS, based on the foregoing, the City Commission of the City of Casselberry has <br />determined the zoning classification of said property shall be PRD, as that district is defined in <br />Articles IV and V of Chapter II, as amended and supplemented, of the Unified Land Development <br />Regulations, Code of Ordinances of the City of Casselberry, Florida. <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. That the Official Zoning Map established in Chapter II, Article IV, Section <br />2-4.3. of the Unified Land Development Regulations of the Code of Ordinances of the City of <br />Casselberry, Florida, as amended and supplemented, be, and the same is, designates the Property <br />described in "Attachment B," consisting of approximately 7.35 acres, PRD (Planned Residential <br />District), as shown in "Attachment A." <br />SECTION II. That the Slovak Garden PUD established in Ordinance No. 21-1551 and <br />recorded in O.R. Book 9911, Page 380, et. seq., of the Public Records of Seminole County, Florida, <br />is hereby amended as identified in the Amended and Restated PUD agreement as attached as <br />"Attachment B" and made a part of this ordinance. <br />SECTION III. CONFLICTS. All Ordinances or parts of Ordinances in conflict with any <br />of the provisions of this Ordinance are hereby repealed to the extent of the conflict. <br />SECTION VI. SEVERABILITY. If any Section or portion of a Section of this Ordinance <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Ordinance. <br />SECTION V. EFFECTIVE DATE.
