ORDINANCE 24-1592 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, <br />FLORIDA, AMENDING THE PLANNED UNIT DEVELOPMENT (PUD) <br />AGREEMENT AND CONCEPT PLAN FOR THE SECOND PHASE OF <br />DEVELOPMENT OF THE SLOVAK GARDEN PUD ESTABLISHED VIA <br />ORDINANCE NO. 21-1551; PROVIDING SPECIFIC ZONING <br />STANDARDS FOR TWO PARCELS APPROXIMATELY 7.35 ACRES <br />LOCATED AT 3110 HOWELL BRANCH ROAD AND 3128 ORAVA LANE, <br />AS DESCRIBED IN SECTION I OF THIS ORDINANCE; PROVIDING <br />FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. <br />WHEREAS, the subject property described in the attached "Attachment B" (Property) was <br />annexed into the corporate boundaries of the City of Casselberry (City) in 2020 by Ordinance 20- <br />1535; and <br />WHEREAS, the Property consists of Parcel 34-21-30-300-0100-0000 and Parcel 34-21- <br />30-300-01013-0000, which are adjacent and share a common ownership; and <br />WHEREAS, the Property is designated Medium Density Residential on the City's Future <br />Land Use Map (FLUM) of the Comprehensive Plan; and <br />WHEREAS, the City Commission approved an amendment to the City's Official Zoning <br />Map in 2021, rezoning the Property to PRD (Planned Residential Development) via Ordinance 21- <br />1551 to establish the Slovak Garden Planned Unit Development (PUD) and outline standards for <br />the first phase of development; <br />WHEREAS, the PRD (Planned Residential District) zoning district is consistent with the <br />City's Medium Density Residential FLUM designation; and <br />WHEREAS, the Owner desires to substantially modify the existing PUD agreement to <br />provide for the second phase of development to include an age -restricted duplex community with <br />the existing multifamily dwelling units and church to remain; <br />WHEREAS, modifications to existing PUD agreements require approval of a revised PUD <br />agreement and associated concept plan, attached hereto as "Attachment B, per Article XX of <br />Chapter IV, as amended and supplemented, of the Unified Land Development Regulations, Code <br />of Ordinances of the City of Casselberry, Florida; and <br />WHEREAS, the Planning and Zoning Commission/Local Planning Agency has held a <br />public hearing with due public notice to consider the proposed modifications of the PUD <br />agreement and concept plan; and <br />WHEREAS, a public hearing considering the proposed modifications of the PUD <br />agreement and concept plan has been duly held in the City, and, at such hearing, interested parties <br />and citizens were heard; and <br />
