<br />31.3.8.3.3.1 Long Yard Protection - Fire access roads - NFPA FL -1 2021. Not in compliance
<br />by Special Magistrate order but in compliance by 6/19/2024, $250.00 per day, $7,000 fine
<br />imposed for 28 days in violation.
<br />7.9.2.1.1 Performance of System - NFPA FL -101 2021. Case was in compliance by Special
<br />Magistrate order, no fine imposed.
<br />City Code 1-4.3.a: No Building Permit No Building Permit. Not in compliance by Special
<br />Magistrate order but in compliance by 6/19/2024, $150.00 per day, $4,200 fine imposed for
<br />28 days in violation.
<br />31.3.2.1.5 Operational Fire Prevention -Occupancy hazards - NFPA FL -1 2021. Case was in
<br />compliance by Special Magistrate order, no fine imposed.
<br />31.3.6.3.3.1 Pile Protection - Lightweight ladders. - NFPA FL -1 2021. Case was in compliance
<br />by Special Magistrate order, no fine imposed.
<br />42.7.2.8 Housekeeping - NFPA FL -1 2021. Case was in compliance by Special Magistrate
<br />order, no fine imposed.
<br />Staff Presentation: Micelania Acevedo, Code Compliance Supervisor stated that case 23-001880,
<br />subsequent case located at 1681 S. Ronald Reagan Boulevard was inspected on May 23, 2024, May 31,
<br />2024, June 11, 2024, June 19, 2024, June 20, 2024, these inspections all showed progress, as of June 20,
<br />2024 one violation remains, 2-5.3 Land use was not in compliance with the Special Magistrate order dated
<br />May 16, 2024, and there is still an order to cease and desist bringing in new product until the piles are
<br />diminished. A site plan was received for the property on June 12, 2024, and is being reviewed by the
<br />planning division, the violation will remain until the site plan is approved and finalized. Ms. Acevedo
<br />reviewed the case for the Special Magistrate. The violation for 2-5.3 land use violation and is $150.00 per
<br />day should be imposed to begin on May 30, 2024. There are fines accumulated between May 23, 2024, and
<br />June 20, 2024, for violation and fines have accumulated. The Special Magistrate asked if the property owner
<br />was present, Ms. Acevedo advised that the tenant of the business was present.
<br />Discussion: Michael Juan, 585 Queens Mirror Cir addressed the Special Magistrate and stated that thirty
<br />days ago they were given seven days and that was not enough time and was impossible. Mr. Juan
<br />Continued. The Special Magistrate asked Mr. Juan about the ten violations that did not come into
<br />compliance by the compliance date, was it his testimony that none of the violation could have come into
<br />compliance by seven days, that they all needed thirty days? Mr. Juan stated that there were some problems
<br />with scheduling, parts needed to be ordered and stated it was an unrealistic timeframe to make it happen.
<br />The Special Magistrate asked if the City had a response. Ms. Acevedo stated the reason the City asked for
<br />seven days was because it was a huge concern to the residents, also a concern to the fire department. These
<br />violations were a concern for the residents of Casselberry.
<br />Special Magistrate Ruling: A ruling was made by the Special Magistrate that case CE -23-001880, located
<br />at 1681 S. Ronald Reagan Boulevard based on Code Officer testimony, the Respondents did not comply
<br />by the Order imposed on May 23, 2024, (May 16, 2024). It was ordered that the Respondents pay the City
<br />of Casselberry for the violation 2-5.3, Land Use by District a fine in the amount of $150.00 per day for each
<br />day the violation exists, plus any preparation and administrative fees, for each day the violation continues
<br />to exist after May 23, 2024. If the Respondent brings the property into compliance, the burden shall rest
<br />upon the Respondents to immediately notify the Code Compliance Officer.
<br />A ruling was made for the violations that were in compliance by June 20, 2024, but not in compliance by
<br />May 23, 2024. 31.3.2.1.3 $1,400 fine imposed for 28 days in violation, 31.3.6.2.1 * $2,800 fine imposed for
