Code Enforcement Hearing <br />Minutes, March 21, 2024 <br />Page 2 <br />AGENDA CASES IN COMPLIANCE <br />CE -23-003313: Subsequent Case at 2054 S.R. 436 — In compliance, no fine imposed. <br />CE -23-003761: New Case at 1482 Canterbury Circle — Withdrawn due to compliance. <br />CE -23-003784: New Case at 1198 Quintuplet Drive — Withdrawn due to compliance. <br />CE -24-000127: New Case at 878 Wolf Trail — Withdrawn due to compliance. <br />Micelania Acevedo, Code Compliance Supervisor stated that the above cases were withdrawn from the <br />March 21, 2024, hearing and would not be heard. No further action was taken. <br />NEW CASE <br />CE -24-000040: New Case at 148 Mark David Boulevard Violation — City Code 3-10.9 c.l.a <br />Recreational Equipment (Utility Trailers, RV, Camper, ATV, ETC), City Code 3-E10.9.b.a.1 Business <br />Related Vehicles - Commercial Sign Copy Area. <br />Staff Presentation: Micelania Acevedo Code Compliance Supervisor gave testimony for case CE -24- <br />000040, located at 148 Mark David Boulevard. The property was reinspected and found to remain in <br />violation on March 18, 2024. The City requested a correction date of May 16, 2024. If there is no <br />compliance by May 16, 2024, then a fine of $50.00 per day, per violation should then be imposed for each <br />day of non-compliance thereafter. The City requested a subsequent hearing date of May 16, 2024, to <br />determine compliance. Ms. Acevedo stated the City has heard from legal counsel representing the property <br />owner, who requested more time to secure a contractor to install the fence. The Special Magistrate asked if <br />there was anyone present to speak about this case. The property owner was present. <br />Discussion: Nicholas Lefils, 148 Mark David Boulevard addressed the Special Magistrate and stated he <br />did not get a January notice and found out about the violations a month ago. Mr. Lefils asked some questions <br />about what will get the property into compliance and asked for an extension of time. <br />Special Magistrate Ruling: A ruling was made by the Special Magistrate that case CE -24-000040, located <br />at 148 Mark David Boulevard was in violation of the City Code Section as listed on the Notice of Code <br />Violation, based on testimony and evidence provided by the Code Enforcement Officer and Respondent. It <br />was ordered that the Respondent shall cure the violation by 1:00 p.m. June 17, 2024. If there is no <br />compliance by June 17, 2024, then a fine of $50.00 per violation, per day will be imposed for each day the <br />property remains in non-compliance. A Subsequent hearing will be held on June 20, 2024, to determine if <br />compliance has been achieved. <br />CE -23-000130: Subsequent Case at 2639 Cayman Way Violation — City Code 3-10.3.a.2 Buildings <br />and Accessory Structures Damage/Graffiti <br />Micelania Acevedo, Code Compliance Supervisor stated that Case CE -23-000130 was heard by the former <br />Special Magistrate on January 18, 2024, the Respondent was given until March 18, 2024, to come into <br />compliance or a $100.00 per day fine would be imposed. The March 18, 2024, inspection revealed the <br />property was still in violation and the fine of $100.00 per day should be imposed. The Special Magistrate <br />asked if there was anyone present to speak about this case. There was no one present. <br />
