Street Lighting Assessment <br />Preliminary Rate Resolution <br />"Excluded Parcels" means Tax Parcels comprising Excluded Subdivisions, Vacant <br />Property, Undevelopable Property, and any areas located within the Street Lighting <br />Service Area that are used for public purposes and do not receive a special benefit from <br />the Street Lighting Services, including by way of example and not limitation, right-of-ways <br />and utility easements. <br />"Excluded Subdivisions" means those platted subdivisions within the City for <br />which the respective homeowners' association or members thereof pay Duke Energy <br />directly for lighting the platted right-of-ways therein. Excluded Subdivisions currently <br />include Lake Griffin Estates, Lost Lake Estates, Legacy Park, Legacy Park Phase III, Field <br />Club, Summit Village, Greenville Commons, Brittany Gardens, Hamlet in the Park, Villas of <br />Casselberry and Windward Square. The City Manager may extend the determination as to <br />whether Tax Parcels comprise an Excluded Subdivision after verification, field research, <br />and/or the presentation of competent, substantial evidence by an affected property owner. <br />"Fiscal Year" means the period commencing on October 1 of each year and <br />continuing through the next succeeding September 30, or such other period as may be <br />prescribed by law as the fiscal year for the City. <br />"Fiscal Year 2024-25" means the Fiscal Year commencing October 1, 2024. <br />"General Parcel" means any Tax Parcel that is not a Single Family Residential <br />Parcel or an Excluded Parcel. <br />"Government Property" means property owned by the United States of America, <br />the State of Florida, a sovereign state or nation, a county, a special district, a municipal <br />corporation, or any of their respective agencies or political subdivisions. <br />91 <br />
