Street Lighting Assessment <br />Preliminary Rate Resolution <br />(L) The provision of Street Lighting Services for Vacant Property primarily <br />benefits adjacent Developed Property rather than preserving the value of Vacant Property <br />or the use and enjoyment of the Vacant Property. Accordingly, Vacant Property shall be <br />excluded from the Street Lighting Assessment contemplated hereunder. As Vacant <br />Property is developed, an Assessment shall be imposed against the previously Vacant <br />Property based upon the apportionment methodology approved herein and such property <br />shall be added to the Street Lighting Assessment Roll approved by a subsequent Annual <br />Rate Resolution in accordance with Section 3.08 of the Assessment Ordinance. <br />(M) It is fair and reasonable to use ERUs assigned based upon the size of <br />General Parcels to apportion the Street Lighting Assessed Cost because the necessary <br />pole spacing and illumination required to meet the City's lighting standards is driven by the <br />size of the General Parcel. <br />(N) The Need Study and Rate Study have been considered by the City <br />Commission in adopting this Resolution. The apportionment methodology and rate <br />classification system described in the Rate Study and based upon the size of Tax Parcels <br />and Equivalent Residential Units is reasonable and equitable, and will continue to be so as <br />properties within the City develop and change; and it is also manageable and capable of <br />being fairly implemented from year to year without wasteful or extraordinary consumption of <br />resources. <br />(0) The apportionment method described in the Rate Study and adopted in <br />Section 3.03 hereof bears a reasonable relationship to the cost of providing Street Lighting <br />Services. <br />9 <br />
