<br />GRANTOF-EASEMENT
<br />THIS INDENTURE, made this L_y day of 14arir1 _,
<br />2009, between SEMINOLE COUNTY PUBLIC SCHOOLS, whose physical
<br />address is 400 East Lake Mary Boulevard, Sanford, Florida 32773-7127, County
<br />of Seminole, and State of Florida, Grantor, and CITY OF CASSELBERRY,
<br />FLORIDA, a municipal corporation, of 95 Triplet Lake Drive, Casselberry, FL
<br />32707, Grantee;
<br />WITNESSETH, that Grantor, for and in consideration of the sum of one
<br />dollar and other valuable consideration paid by Grantee, receipt whereof is
<br />hereby acknowledged, grants and conveys to Grantee, its successors, assigns,
<br />licensees, an exclusive perpetual easement, as described and illustrated below,
<br />("Easement"), which is to be under, upon, and across the property situated in or
<br />near the City of Casselberry, Seminole County, Florida, more particularly
<br />described as:

<br />Sketch of Description attached as Attachment "A"
<br />Seminole County Parcel ID No.: 16-21-30-300-0070-0000; ("Easement Area")
<br />for a bike trail, including but not limited to, the right to construct, install,
<br />reconstruct, repair, remove, replace, inspect, maintain and operate pedestrian
<br />and bike trails, and related facilities, appurtenances and utilities, paved or
<br />unpaved, for the use and enjoyment of the general public, hereafter on said
<br />property, such Easement to include the right of ingress and egress over and
<br />across said property for the purposes of constructing, installing, and maintaining
<br />said facilities. The facilities shall be constructed as depicted on the construction
<br />plans prepared by Giatting Jackson Kercher Anglin dated February 13, 2009.
<br />Grantee shall construct a fence with a gate separating the Easement Area from
<br />the rest of the Grantor's property, which fence shall be approved by the Grantor.
<br />Said gate will be locked by school personnel during non -school hours.
