RESOLUTION 09-2016 <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA APPROVING AND <br />AUTHORIZING THE EXECUTION OF A GRANT OF EASEMENT DOCUMENT WITH <br />SEMINOLE COUNTY PUBLIC SCHOOLS FOR THE CASSELBERRY BIKE TRAIL <br />PHASE II; PROVIDING FOR CONFLICTS, SEVERABILITY AND EFFECTIVE <br />DATE. <br />WHEREAS, trail systems are a valuable asset to the vibrancy of a community providing <br />outlets and opportunities for both recreation and transportation; and <br />WHEREAS, trail systems provide an economic benefit to cities and neighborhoods <br />where trails exist and are a significant element of the City of Casselberry's Comprehensive Plan; <br />and <br />WHEREAS, the City desires to construct the Casselberry Bike Trail Phase II along the <br />southern and eastern property of South Seminole Middle School and Casselberry Elementary <br />School; and <br />WHEREAS, a Grant of Easement is required by the City in order to construct the <br />Casselberry Bike Trail Phase II on Seminole County Public Schools property located on South <br />Seminole Middle School and Casselberry Elementary School. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves the <br />Grant of Easement (attached as Exhibit "A") with Seminole County Public Schools in order to <br />construct the Casselberry Bike Trail Phase II on South Seminole Middle School and Casselberry <br />Elementary School property and authorizes the Mayor to execute said document on behalf of the <br />City. <br />SECTION H. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION M. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />SECTION IV.
