the operation of any amplified sound device in such a manner that it exceeds the <br />following sound level limits: <br />i. From 7:00 p.m. to 10:00 p.m. daily: sound levels shall not exceed sixty (60) <br />dBC when measured within the premises of a complainant <br />ii. From 10:00 p.m. daily to 7:00 a.m. the following day: sound levels shall not <br />exceed fifty five (55) dBC when measured within the premises of a <br />complainant. <br />iii. Sound level limits in Table 1 shall apply when sound level measurements <br />are taken outdoors or within the property line of the complainant. <br />2 Commercial operations No person shall cause, allow, or permit the loading. unloadin <br />opening or otherwise handling of boxes, crates, containers, garbage cans, or recyclable <br />containers, between the hours of 7:00 p.m. and 7:00 a.m. daily when such operations are <br />conducted on a commercial property located within two hundred fifty (250) feet of a <br />residential use. <br />3. Construction and Demolition: <br />a. No person shall operate or cause to be operated any equipment used in construction, <br />repair, alteration or demolition work on buildings, structures, streets, alleys, or <br />appurtenances thereto with sound -control devices less effective than those provided <br />on the original equipment. <br />b. No person shall erect, demolish, alter or repair any building other than between the <br />hours of 7:00 a.m. and 8:00 p.m. on Mondays through Saturdays. <br />1) If the City Manager or designee finds there is a reason to allow erection, <br />demolition, alteration or repair outside those hours, then the City Manager <br />or designee may grant a permit for such work. The valid reasons for granting <br />such a permit are: <br />A) an emergency exists; or <br />(B) the public health and safety will not be impaired, and loss or <br />inconvenience would result to a party in interest if the permit was <br />not granted. <br />2) An application for the permit for work outside the hours in subsection (3)(b) <br />shall be submitted and approved prior to initiating work within the revised <br />timeframe. <br />(3) The decision by the City Manager or designee shall be appealable to the <br />City Commission within five days of the rendition of the decision <br />Ordinance 24-1599 <br />Page 7 of 10 <br />
