First Reading of Ordinance 24-1594 - Amending Section 3-16.4 On -Premises Temporary <br />Sign Regulations, of the City's Unified Land Development Regulations <br />The City Clerk read Ordinance 24-1594 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING ARTICLE XVI, <br />SIGNS, CHAPTER III, PERFORMANCE CRITERIA OF THE UNIFIED LAND DEVELOPMENT <br />REGULATIONS TO AMEND SECTION 3-16.4, ON -PREMISES TEMPORARY SIGN <br />REGULATIONS TO REDUCE THE SQUARE FOOTAGE OF TEMPORARY NON- <br />RESIDENTIAL SIGNS, AND TO REMOVE THE REGISTRATION REQUIREMENTS FOR <br />NONCOMMERCIAL TEMPORARY SIGNS AND SMALL COMMERCIAL SIGNS; PROVIDING <br />FOR CODIFICATION, CONFLICTS, SEVERABILITY AND AN EFFECTIVE DATE." <br />Staff Presentation: Chief Planner Antonia DeJesus gave an overview of Ordinance 24-1594 which <br />amends Section 3-16.4, On -premises temporary sign regulations, of the City's Unified Land Development <br />Regulations (ULDR), to remove associated fee and registration requirements and to refine and simplify <br />related performance standards. In order to adapt to changing circumstances and to promote ease of access <br />and compliance for residents and businesses, the City is proposing an amendment to Section 3-16.4 of the <br />ULDR to clarify registration and fee requirements for temporary signs with commercial and non- <br />commercial messaging, refine the allowable size and number of temporary signs, and simplify regulations <br />based on either a residential or non-residential principal use. The proposed amendment eliminates the $4.00 <br />fee for all temporary signage sized six (6) square feet or less; clarifies that on -premises temporary signs <br />with non-commercial messaging do not require registration with the City, nor payment of a fee; and <br />requirements are simplified into two categories based on whether the principal use of a subject property is <br />residential or non-residential. Ms. DeJesus provided a summary of the performance standards for all <br />temporary signs for all land uses as set forth in the proposed amendment which included maximum number <br />of temporary signs per parcel; maximum sign size for a temporary sign; maximum sign height for a <br />temporary ground sign; maximum sign height for a temporary wall sign (inclusive of a window sign); <br />minimum sign setback required to be maintained by a temporary ground sign from edge of right-of-way; <br />minimum spacing that is required to be maintained by a temporary ground sign from any other temporary <br />ground sign; and maximum aggregate surface area allocated for all temporary signs on a parcel. She also <br />noted that one additional change was that the duration for display of a temporary commercial sign for <br />businesses having an active business tax receipt had been increased from 30 to 35 days. The Planning and <br />Zoning Commission voted unanimously 6-0 at its meeting on January 10, 2024 to recommend approval of <br />Ordinance 24-1594 to the City Commission. The proposed amendment does not compromise the integrity <br />of the City's temporary signage regulations and is consistent with the City's ULDR and Comprehensive <br />Plan. <br />Budget Impact: There is no impact on the City Budget. <br />Recommendation: The City Manager and the Community Development Director recommended approval <br />of Ordinance 24-1594 on first reading. <br />
