CASSELBERRY CITY COMMISSION <br />Minutes of April 22, 2024 — Regular Meeting <br />Page 9 of 11 <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE CITY OF <br />CASSELBERRY ZONING MAP AS ESTABLISHED IN CHAPTER II, ARTICLE IV, SECTION <br />2-4.3, OF THE UNIFIED LAND DEVELOPMENT REGULATIONS, CODE OF ORDINANCES <br />OF THE CITY OF CASSELBERRY, FLORIDA, AS AMENDED AND SUPPLEMENTED; <br />AMENDING THE ZONING CLASSIFICATION FROM SEMINOLE COUNTY C-1 <br />(COMMERCIAL) TO CITY OF CASSELBERRY PMX-MID (PLANNED MIXED USE: <br />MEDIUM -RISE) FOR APPROXIMATELY 0.82 ACRES, LOCATED AT 1550 S.R. 436, AS <br />DESCRIBED IN SECTION I OF THIS ORDINANCE; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND AN EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to second reading of Ordinance 24-1598 <br />was advertised in the Orlando Sentinel on Thursday, April 11, 2024. <br />Business Impact Statement: A Business Impact Statement was provided for this ordinance in accordance <br />with Section 166.041(4), Florida Statutes. <br />Staff Presentation: Planner I Matt Linder gave an overview of Ordinance 24-1598 which amends the <br />official zoning classification for one (1) parcel located at 1550 S.R. 436 (Parcel ID 33-21-30-300-007B- <br />0000) from Seminole County C-1 (Commercial) to City of Casselberry PMX-MID (Planned Mixed Use: <br />Medium Rise). The subject property is approximately 0.82 acres and was recently annexed into the City. <br />The Future Land Use Map (FLUM) designation for the subject property was amended to Major <br />Thoroughfare Mixed Use (MTMU) via Ordinance 24-1596 adopted by the City Commission March 25, <br />2x24, 1Jiireh r� VvilJrJtellt JJrtii rile pr'vpvsed DMX -MID Zoning district. The Piaiii�iiig and d Zvnriig <br />Commission, acting as the City's Land Planning Agency (LPA), voted unanimously 4-0 at its meeting on <br />March 13, 2024 to recommend approval of Ordinance 24-1598 to the City Commission. The request to <br />amend the Official Zoning Map designation for the subject property from Seminole County C-1 <br />(Commercial) to City of Casselberry PMX-MID (Planned Mixed Use: Medium Rise) is consistent with the <br />City's Comprehensive Plan and the Major Thoroughfare Mixed Use FLUM designation; compatible and <br />consistent with the adjacent land uses and zoning districts; and City water and sanitary sewer services are <br />available for the subject property. <br />Budget Impact: There is no impact on the City Budget. <br />Recommendation: The City Manager and the Community Development Director recommended adoption <br />of Ordinance 24-1598 on second and final reading. <br />Public Hearing: Vice Mayor Aramendia stated this was a public hearing to hear and consider comments <br />and questions regarding Ordinance 24-1598. Vice Mayor Aramendia opened the floor for public <br />participation. No one came forward to address Ordinance 24-1598. Vice Mayor Aramendia closed the <br />public hearing relative to Ordinance 24-1598. <br />MOTION: Commissioner Divita moved to adopt Ordinance 24-1598 on second and final <br />reading, as presented. Motion was seconded by Commissioner Busch. Motion <br />carried unanimously by voice vote 3-0. <br />
