Ms. Powell stated that the City had shut down two of the stair towers, at building 1100 and <br />1140 (Castle Wood Terrace). Ms. Powell continued. <br />Jay Calvert, Calvert Construction, 9056 Great Heron Circle, Orlando, FL added that the engineering team <br />provided the documents, and he is under contract to perform the repairs, and this is contingent on building <br />permits being issued. Mr. Calvert Continued. <br />Mr. Kovecses continued and stated that more time was being requested to get the violations resolved before <br />the fine was imposed. The Special Magistrate asked if a copy of the letter submitted to the City was <br />available. Mr. Kovecses came forward and presented the letter as part of the official record and entered at <br />Respondents composite exhibit A. <br />The Special Magistrate asked in relation to violation 1-4.3. a, no building permit, what building permit do <br />they not have? Ms. Acevedo stated that they have submitted permits for violation that are in existence and <br />the permits must be finalized and they are not. The Special Magistrate asked which permits are not finalized. <br />Ms. Acevedo stated the permits for the stairwells, air conditioning units, a storage container that is outside <br />on the property, and other buildings with stairwell issues. Ms. Acevedo read a list of items requiring permits, <br />air conditioning units, additional dumpster at the property, any structural pen -nits and need to be applied <br />for, gutters and downspouts, windows that need repairs. <br />The Special Magistrate asked Ms. Acevedo about the outstanding permits for roofs, gutters, downspouts <br />maintenance, and whether they are still outstanding. Ms. Acevedo stated yes they are outstanding and that <br />the orders state not only to obtain a pennit but to complete and finalize. Ms. Acevedo stated there are air <br />conditioner permits that have been finalized but other units are not working and need permits applied for. <br />Permits have been submitted for the stairs and they are actively doing the repairs but there are other stairs <br />on the property that need to be applied for. Ms. Acevedo stated reports were submitted and the Chief Fire <br />Marshal is reviewing the reports, as well as the building code official. The report states that all buildings, <br />per the findings, are required to have temporary shoring, this has not been done, the report was dated April <br />11, 2023. Ms. Acevedo stated this was an increased concern regarding the structural safety of the building. <br />Mr. Kovecses stated they were there for what was in the order and not new violations. <br />Kayla Reyes, 1100 Castle Wood Terrace gave testimony and stated the day the new owner closed her <br />apartment flooded, as of September 21, 2023, no one had come to check for mold or sanitize. The fix for <br />trash was putting another trash bin in front of where they deposit their trash which is about 10 feet high. <br />Ms. Reyes stated she had proof of mold growing in her child's closet and her child has a pulmonary <br />condition. Ms. Reyes continued and submitted a packet with photos and a letter, entered at Residents <br />composite exhibit A. <br />John Rice, 1100 Castle Wood Terrace gave testimony and stated he also had received a letter for eviction. <br />Mr. Rice had someone get into his PayPal account which is attached to his bank account and had money <br />stolen. In regard to safety issues, Mr. Rice spoke to a representative in April (2023) about the gutters which <br />are full of weeds and as a former firefighter, if there was a fire on the top floor the fire could travel down <br />the gutters and spread the fire. Mr. Rice continued. <br />Jennifer Nix, Assistant City Attorney stated while the City can appreciate the efforts the respondent has <br />stated they are making, it does not appear based on testimony and evidence that compliance has been <br />achieved to any of the violation, with the exception of the disabled/unlicensed parking.
