Code Enforcement Hearing <br />Minutes, September 21, 2023 <br />Page 2 <br />The Special Magistrate asked if anyone present had any additions or corrections to the modified <br />Minutes from the August 17, 2023, hearing; there were none. The Special Magistrate approved the modified <br />Minutes from the August 17, 2023, hearing. <br />6. Statement of Evidence <br />Supervisor Acevedo advised that all events occurred within the corporate limits of the City. The <br />Officer's notes, case narratives, testimony, photographs, supporting documents and PowerPoint <br />presentation were all entered as part of the official record. <br />7. NEW CASES IN COMPLIANCE <br />CE -23-001036: New Case at 680 Crestview Drive Violation — City Code 3-10.3.c.5.c 1 & 2 <br />Outdoor/open air storage — Residential. <br />CE -23-001048: New Case at 1013 Wolf Trail Violation — City Code 3-10.9.c.l.a Recreational <br />equipment (utility trailers, RV, camper, atv, etc), City Code 3-10.9. e.2.a.1 Residential designated parking. <br />CE -23-001304: New Case at 140 Lazy Circle Violations — City Code 3-10.3.c.5.c.1 I & 2 <br />Outdoor/openair storage — Residential, City Code 3-10.9.c. La Recreational equipment (utility trailers, RV, <br />camper, ATV, etc), City Code 3-10.9.e.2.a.1 Residential designated parking. <br />Staff Presentation: Micelania Acevedo, Code Compliance Supervisor advised that the above cases were <br />in compliance prior to the September 21, 2023, meeting and would not be heard. No further action was <br />taken. <br />8. CE -22-000564: Subsequent Case at 290 Iris Road Violation — City Code 3-10.3.c.5.b <br />Outdoor/openair storage — Commercial or Industrial, City Code Parking areas used for purposed other <br />than parking, City Code 3-15.4.d Paving of parking surface, maintenance and construction <br />specifications, City Code 3-15.6.d Accessibility parking and passenger loading zones, City Code <br />Disabled, inoperable, or abandoned vehicle(s), City Code 82-131.c Unlawful disabled parking. <br />Staff Presentation: Micelania Acevedo, Code Compliance Supervisor advised that case 22-000564, 290 <br />Iris Road was not in compliance and the owner was working with the City to submit the permit application <br />but has yet to do so and fines should be imposed. The Special Magistrate asked if there was anyone present <br />to speak about this case, there was no one present. <br />Special Magistrate Ruling: A ruling was made by the Special Magistrate that case CE -22-000564, located <br />at 290 Iris Road based on Code Officer testimony, the Respondents did not comply by the order imposed <br />on March 16, 2023. It was ordered that the Respondents pay the City of Casselberry a fine in the amount <br />of $150.00 per day for each day the violation exists and each day the violations continues to exist past the <br />date of compliance of September 18, 2023. The burden shall rest upon the respondents to immediately <br />notify the Code Compliance officer. <br />9. CE -23-000284: Subsequent Case at 1095 W S.R. 434 Violations — City Code 3-16.10.a No sign <br />permit — larger than 6 square feet, City Code 3-16.4.b.9 Temporary sign removal, City Code 1-4.3 No <br />building permit, City Code 3-16.3.c.3.b Window sign requirements. <br />
