The City requested a subsequent hearing date of 11/14/2019 to determine compliance. Donna <br />Peterson, property manager, provided testimony. <br />The Special Magistrate made a finding that CE -19-001726, located at 212 N Cypress Way, was in violation of the City <br />Code Section as listed on the notice of code violation, based on testimony and evidence provided by the Code Enforcement <br />Officer. It was ordered that the respondent shall cure the violation by 1:00 P.M. December 1, 2019. If there is no <br />compliance by December 1, 2019, then a fine of $75.00 per day will be imposed for each day the property remains in non- <br />compliance. A subsequent hearing will be held on December 12, 2019, to determine if compliance has been achieved. <br />CE -19-001692 1061 Osceola Trl. <br />• Unlicensed and/or Inoperable Vehicles, ULDR Section 3-10.9.f <br />Officer Acevedo, provided testimony and read case information into record. The City requested a correction date of <br />10/24/2019. If no compliance by 10/24/2019, then a fine of $50.00 per day should then be imposed for each day of non- <br />compliance thereafter. The City requested a subsequent hearing date of 11/14/2019 to determine compliance. Richard <br />Casselberry, property owner of 1061 Osceola Trl., provided testimony. <br />The Special Magistrate made a finding that CE -19-001692, located at 1061 Osceola Trl., was in violation of the City Code <br />Section as listed on the notice of code violation, based on testimony and evidence provided by the Code Enforcement <br />Officer. It was ordered that the respondent shall cure the violation by 1:00 P.M. October 24, 2019. If there is no compliance <br />by October 24, 2019, then a fine of $50.00 per day will be imposed for each day the property remains in non-compliance. <br />A subsequent hearing will be held on November 14, 2019, to determine if compliance has been achieved. <br />CASES WITHDRAWN DUE TO OWNERSHIP CHANGE <br />CE -19-001281 1523 Canterbury Cir. <br />CE -19-001729 1523 Canterbury Cir. <br />Supervisor Campbell, advised that the above cases were being withdrawn due to ownership change. Officer Alcuri, <br />advised that the property came before the Special Magistrate in September, the Property Appraiser was still showing <br />Wells Fargo as the owner. The Property Appraiser has since updated the deed and prior to the last hearing, Wells Fargo <br />was not the owner. This caused the cases the City had to be closed and notices to be re -issued, under the new ownership. <br />Officer Alcuri has spoken to the new property representative, with US National Bank, and provided a list of all the <br />violations. <br />Officer Alcuri, advised that the eviction process still has to be done by the property owner. The Special Magistrate asked <br />when the eviction process started. Officer Alcuri, stated the process was started two and a half weeks prior to the October <br />hearing. Discussion ensued. <br />Victor Lutz, Casselberry resident, spoke about 1523 Canterbury Cir. There is a mosquito problem with the pool, the garage <br />door is still open, the property still poses a threat to the neighborhood. Mr. Lutz stated, Code Enforcement has done some <br />things, but the property is nowhere near up to code. Mr. Lutz continued. <br />NEW CASES <br />CE -19-001070 212 Cannon Way <br />• Fence in disrepair, City code 3-10.3.b.I <br />Officer Eastwood, provided testimony and read case information into record. The City requested a correction date of <br />11/9/2019. If no compliance by 11/9/2019, then a fine of $250.00 per day should then be imposed for each day of non- <br />compliance thereafter. The City requested a subsequent hearing date of 11/14/2019 to determine compliance.
