qualified electors or the signatures of a number of qualified electors equal to at least two percent <br />of the total number of qualified electors, whichever is the lower. <br />(3) Each petition shall be filed with the City Clerk on or before the third Tuesday in April. The <br />City Clerk shall determine whether the required number of signatures has been obtained for the <br />name of the candidate to be placed on the ballot and shall notify the candidate. <br />Section 7.08. Run-off election and certification of election. <br />The candidate for an office receiving the majority of votes cast shall be elected. If there should be <br />more than two candidates for any office and no one candidate receives a majority of the votes cast <br />in the municipal election held pursuant to Section 34 7.01, or in the event of a tie vote, then the <br />two candidates receiving the highest votes in the first election shall run again in a run-off election <br />to be held on the Tuesday after the first Monday in November. The run-off election shall be held <br />in the same manner as the prior election. The candidate receiving the majority of the votes cast at <br />such run-off election shall be elected. In the event of a tie vote at the run-off election, the tie will <br />be dissolved by a lottery pursuant to state statute. The City Commission, upon confirmation of the <br />returns of the election, shall certify the officers elected and issue certificates of office accordingly. <br />SECTION 3. The City Clerk is hereby directed to ensure that all advertising, translation <br />and notice requirements are complied with and to coordinate all activities necessary to conduct the <br />referendum election called in Section 1 of this Ordinance with the Supervisor of Elections for <br />Seminole County to place the above-described questions on the ballot for referendum election to <br />be held on August 20, 2024, or as otherwise worded in an enabling resolution of the City <br />Commission as may be needed to conform to the requirements of the Florida Election Code or to <br />better state the proposals submitted to the electors of the City of Casselberry. <br />SECTION 4. The proposed amendments, the ballot titles and the wording of the substance <br />of the proposed amendments to the Charter, as contained in this Ordinance, shall appear on the <br />ballot in the form of questions as set forth in Section 2 of this Ordinance. <br />SECTION 5. Conflicts. All Ordinances and Charter provisions or parts of Ordinances <br />and Charter provisions in conflict herewith are hereby repealed. <br />SECTION 6. Severability. If any section, subsection, sentence, clause, phrase or portion <br />of this Ordinance is for any reason held invalid or unconstitutional by any court of competent <br />jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such <br />holding shall not affect the validity of the remaining portion hereto. Further, the lack of approval <br />by a majority of electors of one or more separate amendments to this Charter, as set forth in Section <br />2 herein, shall not be deemed to affect the validity of any amendments that may be approved by a <br />majority of the electors. <br />Ordinance No. 23-1590 <br />Page 9 of 10 <br />
