CASSELBERRY CITY COMMISSION <br />Minutes of June 12, 2023 — Regular Meeting <br />Page I1 of 14 <br />REQUIRED BUFFER; PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY, <br />AND AN EFFECTIVE DATE." <br />Staff Presentation: Chief Planner Antonia DeJesus stated that the Community Development Department, <br />with the Public Works & Utility Department, request approval of Ordinance 23-1583 (LPA 23-01), on first <br />reading, amending Section 3-13.7, Development Landscape and Buffer Requirements, of the Unified Land <br />Development Regulations (ULDR), offering accommodation and flexibility for passive recreational uses to <br />minimally encroach into landscape buffers when site constraints are present. The intent of the proposed <br />ordinance is to enhance pedestrian mobility as part of the City's overall commitment to multi -modal <br />transportation and to allow for some flexibility for sites that have a demonstrated significant site constraint <br />such as a third -party utility easement and that have a specific zoning and future land use designation. This <br />would only apply to properties that are zoned ROS (Recreation Open Space) with a Recreation and Open <br />Space future land use designation and is meant for low impact, recreational uses that would be subject to <br />all of the site plan standards. The Planning and Zoning Commission, acting as the City's Land Planning <br />Agency (LPA) voted 3-1 at its meeting on May 10t" to recommend approval of Ordinance 23-1583 to the <br />City Commission. The proposed amendments are consistent with specific goals, objectives and policies <br />outlined in the City's Comprehensive Plan and Multimodal Transportation Master Plan (MTMP) related to <br />enhancing connectivity and overall community health. In response to questions from the City Commission, <br />Ms. DeJesus clarified that staff would be cognizant of any noise or other impacts to adjoining properties, <br />and in fact, the buffers would ensure compatibility with minimal encroachment. For example, a multi -use <br />path would not be put up against someone's backyard but there would be consideration for that, and there <br />have also been discussions on solutions such as opaque screening, additional shrubs, trees, and that sort of <br />thing, Including getting input'110m the residents to see'w'hat would be preferred. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager, the Community Development Director, and the Public Works & <br />Utilities Director recommended approval of Ordinance 23-1583 (LPA 23-01) on first reading. <br />Audience Participation: No one came forward to address Ordinance 23-1583. <br />MOTION: Vice Mayor Busch moved to approve Ordinance 23-1583 on first reading, as <br />presented.
