CASSELBERRY CITY COMMISSION
Minutes of June 12, 2023 — Regular Meeting
Page I1 of 14
REQUIRED BUFFER; PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY,
AND AN EFFECTIVE DATE."
Staff Presentation: Chief Planner Antonia DeJesus stated that the Community Development Department,
with the Public Works & Utility Department, request approval of Ordinance 23-1583 (LPA 23-01), on first
reading, amending Section 3-13.7, Development Landscape and Buffer Requirements, of the Unified Land
Development Regulations (ULDR), offering accommodation and flexibility for passive recreational uses to
minimally encroach into landscape buffers when site constraints are present. The intent of the proposed
ordinance is to enhance pedestrian mobility as part of the City's overall commitment to multi -modal
transportation and to allow for some flexibility for sites that have a demonstrated significant site constraint
such as a third -party utility easement and that have a specific zoning and future land use designation. This
would only apply to properties that are zoned ROS (Recreation Open Space) with a Recreation and Open
Space future land use designation and is meant for low impact, recreational uses that would be subject to
all of the site plan standards. The Planning and Zoning Commission, acting as the City's Land Planning
Agency (LPA) voted 3-1 at its meeting on May 10t" to recommend approval of Ordinance 23-1583 to the
City Commission. The proposed amendments are consistent with specific goals, objectives and policies
outlined in the City's Comprehensive Plan and Multimodal Transportation Master Plan (MTMP) related to
enhancing connectivity and overall community health. In response to questions from the City Commission,
Ms. DeJesus clarified that staff would be cognizant of any noise or other impacts to adjoining properties,
and in fact, the buffers would ensure compatibility with minimal encroachment. For example, a multi -use
path would not be put up against someone's backyard but there would be consideration for that, and there
have also been discussions on solutions such as opaque screening, additional shrubs, trees, and that sort of
thing, Including getting input'110m the residents to see'w'hat would be preferred.
Budget Impact: There is no impact to the City Budget.
Recommendation: The City Manager, the Community Development Director, and the Public Works &
Utilities Director recommended approval of Ordinance 23-1583 (LPA 23-01) on first reading.
Audience Participation: No one came forward to address Ordinance 23-1583.
MOTION: Vice Mayor Busch moved to approve Ordinance 23-1583 on first reading, as
presented. Motion was seconded by Commissioner Meadows. Motion carried
unanimously by voice vote 5-0.
11. PUBLIC HEARINGS
No items were presented for consideration on this agenda.
12.
