<br />The Special Magistrate asked if anyone present had any additions or corrections to the
<br />Minutes from the July 20, 2023, hearing; there were none. The Special Magistrate approved the
<br />Minutes from the July 20, 2023, hearing.
<br />6. Statement of Evidence
<br />Supervisor Acevedo advised that all events occurred within the corporate limits of the City.
<br />The Officer's notes, case narratives, testimony, photographs, supporting documents and
<br />PowerPoint presentation were all entered as part of the official record.
<br />7. CE -23-001033: New Case at 1131 Castle Wood Terrace Violations — City Code 1-4.3.a No
<br />building permit, City Code 3-10.3.a.2 Buildings and accessory structure damage/graffiti, City
<br />Code 3-10.3.a.4 Roofs, gutters, down spouts — maintenance, City Code 3-10.3.c.1
<br />Overgrowth, weeds, trash and debris, City Code 3-10.9.c.1.a Recreational equipment (utility
<br />trailers, RV, camper, atv, etc.), City Code 3-10.9.f Unlicensed and/or inoperable vehicles,
<br />Ordinance 20-1534 Dumpsters/roll-off containers, City Code 1-4.1 Damaged windows,
<br />skylights, doors. Standard Unsafe Building Abatement Code (SUBAC) Unsafe Building —
<br />Section 1-4.6
<br />Staff Presentation: Supervisor Acevedo gave testimony that the property was reinspected and
<br />found to remain in violation on August 14, 2023. The City requested a correction date of
<br />September 18, 2023. If no compliance by September 18, 2023, then a fine of $250.00 per day
<br />should then be imposed for each day of non-compliance thereafter. The City requests a
<br />subsequent hearing date of September 21, 2023, to determine compliance. The Special
<br />Magistrate asked if there was anyone present to speak about this case, there was a representative
<br />present to speak about this case. Assistant City Attorney Nix, moved to the record a response
<br />communication from the Lowndes Law Firm, on behalf of the Respondent that the City received.
<br />Respondents composite exhibit A was entered into the record.
<br />Discussion: Joe Kovecses, Lowndes Law Firm forward on behalf of the respondent addressed
<br />the Magistrate and asked if all the violations that were on the notice were still on the agenda. Ms.
<br />Acevedo stated no, the utility trailer and GFL (roll off dumpster) were removed from the agenda.
<br />Mr. Kovecses read a timeline to show how they got to where they are as of August 17, 2023. A
<br />lengthy discussion ensued. A letter that was sent to residents trying to address the (trash) problem
<br />was submitted to the record and spoke more about the trash issue.
<br />Audience Participation: Residents of Castle Woods Apartments came forward to speak about
<br />this case.
<br />Natalie Velazquez, 1124 Castle Wood Terrace #108, gave testimony and described the multiple
<br />problems she has had in her apartment, since she has lived there.
<br />Marisela Santiago, 205 N Alderwood Street, Winter Springs, FL, advised she is the mother of the
<br />previous speaker and watches her grandchildren daily. Ms. Santiago spoke of problems with the
<br />trash, the trash compactor, and other problems at the apartment complex.
