Statement of Evidence <br />Supervisor Acevedo advised that all events occurred within the corporate limits of the City. <br />The Officer's notes, case narratives, testimony, photographs, supporting documents and <br />PowerPoint presentation were all entered as part of the official record. <br />7. CE -23-000231: New Case at 201 SR 436 Violations — City Code 58-132 (a)&(b) <br />Open and abandoned property, City Code 3-10.3.c.1 Overgrowth, weeds, trash and <br />debris. <br />Staff Presentation: Supervisor Acevedo advised that CE -23-000231, 201 SR 436 was in <br />compliance and would not be heard. No further action was taken. <br />8. CE -23-000284: New Case at 1095 W SR 434 Violations — City Code 3-16.10.a No <br />sign permit — larger than 6 square feet, City Code 3-16.4.b.9 Temporary sign removal, <br />City Code 1-4.3 No building permit, City Code 3-16.3.c.3.b Window sign requirements. <br />Staff Presentation: Officer Andreone gave testimony that the property was reinspected and <br />found to remain in violation on July 17, 2023. The City requested a correction date of August 17, <br />2023. If no compliance by August 17, 2023, then a fine of $150.00 per day should then be imposed <br />for each day of non-compliance thereafter. The City requests a subsequent hearing date of <br />August 17, 2023, to determine compliance. The Special Magistrate asked if there was anyone <br />present to speak for this case, a representative was present. <br />Discussion: Rabbi Vazion property owner came forward and addressed the Special Magistrate. <br />Special Magistrate Ruling: The Special Magistrate found that CE -23-000284, located at 1095 <br />W SR 434 was in violation of the City Code Sections as listed on the notice of code violation, <br />based on testimony and evidence provided by the Code Enforcement Officer. It was ordered that <br />the respondent shall cure the violations by 1:00 P.M. September 21, 2023. If there is no <br />compliance by September 21, 2023, then a fine of $150.00 per day will be imposed for each day <br />the property remains in non-compliance. A subsequent hearing will be held on September 21, <br />2023, to determine if compliance has been achieved. <br />9. CE -23-000285: New Case at Sunshadow Drive Violation — City Code 3-10.3.c.1 <br />Overgrowth, weeds, trash and debris. <br />Staff Presentation: Officer Andreone gave testimony that the property was reinspected and <br />found to remain in violation on July 17, 2023.
