Approval of Expenditure Report <br />MOTION: Moved by Police Officer Robbin Lilly to approve the Expenditure <br />Report dated February 13, 2003. Motion was seconded by Mr. Frank <br />A. Schutte and carried unanimously by voice vote. <br />VIII. Approval of Return of Contributions <br />MOTION: Moved by Mr. Frank A. Schutte to approve the Return of <br />Contribution in the amount of $954.14 for Jason O'Conner as <br />requested in the letter dated February 12, 2002 from Mr. Jeffrey <br />Dreier. Motion was seconded by Police Officer Robbin Lilly and <br />carried unanimously by voice vote. <br />IX. Attorney'sport <br />Mr. Scott Christiansen updated the Board on the administrative action where the City of <br />Casselberry, along with five other cities and the Florida League of Cities are challenging <br />interpretation of the language by the Florida Division of Retirement regarding the use of <br />additional State monies the City receives pursuant to our participation in Chapter 175 and 185. <br />The Division of Retirements interpretation is that monies received over and above what was <br />received in 1998 has to be used for additional benefits. The Division of Retirement is in the <br />process of promulgating a rule which sets out their interpretation of the Statutory language <br />regarding the additional State benefits. There is also legislation that has been pre -filed in <br />Legislature that proposes to change Chapter 175 and 185 to add the additional language that the <br />Division of Retirement is currently using as their interpretation. Also, in the same bill they are <br />proposing the establishment of a data base that is made up of all the property records from each <br />of the cities in the State and this would be used by the insurance companies that are collecting <br />State premium tax dollars will be required to use the data base to properly allocate the money <br />among the cities. <br />The Attorney also reported on a bill that had been pre -filed in the Legislature regarding the <br />Malcolm Thompson Act, which provides that a police officer injured in the line of duty as a <br />result of a violent act, be given a minimum disability of eighty percent instead of forty-two <br />percent. <br />
