PISTOL RANGE AGREE NIENT +CITY OF NEW SMYRNA BEACH THIS AGREEMENT made and entered into this day of j �20f ? between the City of New Smyrna Beach, amunicipal corporation ofthe State ofFlorida, hereinafter referred to as "New Smyrna Beach," and the City of Casselberry, Florida hereinafter referred to as "Permittee." WITNESSETH WHEREAS, in order that Permittee and its agents or employees may maintain a level of performance in its use of firearms commensurate with their obligations and responsibilities as law enforcement or military officers, and in consideration of the mutual promises hereinafter contained in this Agreement, this Agreement is entered into to enable Permittee to use the New Smyrna Beach Police Department Pistol Range. NOW, THEREFORE, the parties hereto agree as follows: The above recitations are true and correct. 2. New Smyrna Beach hereby agrees to permit the agents or employees of Permittee to use the New Smyrna Beach Police Department Pistol Range at such time(s) as are mutually agreed upon between the parties in accordance with individual departmental schedules. During this period ofpistol range use byihe agents or employees ofPermittee, said agents or employees will be under the control and direction of the New Smyrna Beach Police DepartmentRange Officer in addition to being subject to any and all rules and regulations for the use of the range which maybe provided for in the New Smyrna Beach Police Department's Policies and Procedures or Rules and Regulations, which shall be provided to the Permittee Training Instructor upon request. 3. Permittee agrees to provide ammunition for its agents or employees which conforms to any and all specifications set by the New Smyrna Beach Police Department Range Officer and to utilize only weapons which conform to any and all specifications set by said Range Officer, 4. Permittee further agrees to provide a qualified instructor/range officer to provide training for and immediate supervision of its agents or employees utilizing the New Smyrna Beach Police Department's Pistol Range during such times as said range is used by Permittee. 5. Permittee shall indemnify and save harmless New Smyrna Beach, its agents and employees, from and against all claims, suits, actions, damages or causes ofaction arising during the term ofthis Agreement for anypersonal injury, loss of life or damage to property sustained by reason Pagel of 3
