CASSELBERRY CITY COMMISSION <br />Minutes of March 27, 2023 — Regular Meeting <br />Page 13 of 16 <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Finance Director recommended approval of Resolution 23- <br />3560. <br />Audience Participation: No one came forward to address Resolution 23-3560. <br />MOTION: Commissioner Aramendia moved to approve Resolution 23-3560, as presented. <br />Motion was seconded by Vice Mayor Busch. Motion carried unanimously by <br />voice vote 4-0. <br />10. FIRST READING OF ORDINANCES <br />A. Ordinance 23-1581 — Amending the Official Zoning Designation for the Property <br />Located at 5803 S. U.S. Hwy. 17-92 and Approving the Associated PUD <br />Agreement (ZB 22-08) <br />The City Clerk read Ordinance 23-1581 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBER Y, FLORIDA, TO AMEND THE CITY OF <br />CASSELBERRY OFFICIAL ZONING MAP AS ESTABLISHED IN CHAPTER II, ARTICLE IV, <br />SECTION 2-4.3, UNIFIED LAND DEVELOPMENT REGULATIONS OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS AMENDED AND SUPPLEMENTED; AMENDING THE <br />ZONING CLASSIFICATION FROM PMX-H (PLANNED MIXED-USE: HIGH INTENSITY) TO <br />PMX-HIGH (PLANNED MIXED-USE: HIGH RISE) FOR ONE PARCEL, TOTALING <br />APPROXIMATELY 15.66 ACRES, LOCATED AT 5803 S US HWY 17-92, AS DESCRIBED IN <br />SECTION I OF THIS ORDINANCE; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN <br />EFFECTIVE DATE." <br />Staff Presentation: Planner I1 Antonia DeJesus stated Ordinance 23-1581 amends the official zoning <br />designation for one (1) parcel located at 5803 S. U.S. Hwy. 17-92 from PMX-H (Planned Mixed -Use: High <br />Intensity) to PMX-HIGH (Planned Mixed -Use: High Rise). The proposed zoning district, PMX-HIGH <br />(Planned Mixed -Use: High Rise) is classified as a Planned Unit Development (PUD) zoning district and <br />execution of a PUD Agreement is required as part of the rezoning process. The subject area consists of <br />approximately 15.66 acres and is located at the northeast corner of the intersection of S. U.S. Hwy 17-92 <br />and SR 436. The site is located within the Community Redevelopment District (CRD) and the Oxford Park <br />Overlay District (OPOD). The current zoning of the subject property, PMX-H (Planned Mixed -Use: High <br />Intensity) is not consistent with the existing Future Land Use Map (FLUM) designation of Major <br />Thoroughfare Mixed -Use (MTMU). Therefore, the applicant is requesting an amendment to the Official <br />zoning Map to rezone the property to PMX-HIGH (Planned Mixed -Use: High Rise) in order to correct the <br />inconsistency so that the site can be redeveloped. On February 22, 2023 notices for the proposed amendment <br />to the Official Zoning Map were posted at the subject property, and written notification letters were mailed <br />to all surrounding property owners within 500 feet of the subject property. The Planning and Zoning <br />Commission, serving as the City's Local Planning Agency (LPA), voted unanimously at its meeting on <br />
