CASSELBERRY CITY COMMISSION <br />Minutes of September 28, 2015 — Regular Meeting <br />Page 18 of 26 <br />Initial violation for dead tree December 2014 <br />• Case heard by Code Enforcement Special Magistrate March 9, 2015 and a date for compliance set <br />• Case heard by Code Enforcement Special Magistrate April 9, 2015 and $25/day fine imposed. <br />• Property found to be in compliance July 27, 2015 and fine stopped accruing. Fine had accrued to <br />$3,150 at that time. <br />• Lien reduction request denied by Code Enforcement Special Magistrate. <br />• August 18, 2015 City Manager upheld Code Enforcement Special Magistrate's denial for a reduction <br />of lien. <br />• August 20, 2015 Joyce Sanders, agent for Seller, filed an appeal of the City Manager's decision via <br />email, requesting consideration by the Commission. <br />Discussion: A brief discussion ensued regarding the reason for the delay in compliance, foreclosure <br />proceedings resulting in the bank taking ownership; the issue of the tenant remaining on the property after the <br />bank took ownership, and the fact that no reason had ever been given for the delay. Ms. Reischmann clarified <br />that the Certificate of Title was issued in December of 2014 and she believed the Writ of Possession was issued <br />in March of 2015. <br />Mayor Glancy inquired whether anyone was present on behalf of the applicant and was advised no one was. <br />Budget Impact: Revenue has been budgeted in FY 2015 for Code Enforcement lien payments in the General <br />Fund Violations of Local Ordinances/Code Enforcement revenue account #001-0000-354.20-00. <br />Recommendation: The City Manager and the Community Development Director recommended that the City <br />Commission consider the appeal as requested by Joyce Sanders, Agent for Seller, regarding a reduction denial <br />of a Code Enforcement Lien on the property located at 4 Carriage Hill Circle for Case Number CE -14-01206. <br />MOTION: Commissioner Aramendia moved to approve the denial of a reduction of the <br />Code Enforcement lien imposed on property located at 4 Carriage Hill Circle in <br />Case No. CE -14-01206. Motion was seconded by Vice Mayor Solomon. Motion <br />carried unanimously by voice vote 5-0. <br />10. FIRST READING OF ORDINANCES <br />No items were presented for consideration on this agenda. <br />11. PUBLIC HEARINGS <br />At 5:54 p.m. City Clerk Donna Gardner announced for the record that the final Public Hearings for the City of <br />Casselberry's FY 2015-2016 millage rate and budget had been advertised for 5:15 p.m. and would now begin. <br />
