G. INSURANCE <br />1. General Liability Insurance <br />The CONSULTANT will purchase and maintain such liability <br />insurance as will protect it from claims under Worker's <br />Compensation laws, disability benefit laws, or other similar <br />employee benefit laws from claims for damages because of bodily <br />injury, occupational sickness or disease, or death of its employee; <br />claims for damages because of bodily injury, sickness or disease, <br />or death of any person other than its employees, including claims <br />insured by usual personal injury liability coverage; and from claims <br />for injury to or destruction of personal property, including loss of <br />use resulting there from, any or all of which may arise out of or <br />result from the CONSULTANT'S direct operations under this <br />Agreement, The General Liability limits of liability which must be <br />carried by the CONSULTANT shall not be less that $1,000,000.00 <br />per occurrence and $1,000,000.00 aggregate. This insurance shall <br />contain a provision that the coverage afforded under the policy(ies) <br />will not be canceled, until at least thirty (30) calendar days prior <br />written notice has been given to the CONSULTANT. Following <br />CONSULTANT's receipt of a written notice from its insurance <br />carrier, written notice shall be provided to the CITY by the <br />CONSULTANT within twenty one (21) days of CONSULTANT <br />receiving written notice from its insurance carrier. <br />2. Professional Liability Insurance <br />During the term of this Agreement, the CONSULTANT will carry <br />Errors and Omission insurance which will cover liability for any <br />damage on account of any error, omission, or other provable <br />negligence caused wholly by the CONSULTANT. The amount of <br />insurance shall not be less that $1,000,000.00 per occurrence and <br />aggregate. The CITY may require a higher limit and reimburse the <br />CONSULTANT for any additional cost of such requested policy as <br />mutually agreed to with the CONSULTANT for a specific project. <br />This insurance shall contain a provision that the coverage afforded <br />under the policy (ies) will not be canceled until at least thirty (30) <br />calendar days prior written notice has been given to the <br />CONSULTANT.
