Minutes of January 11, 2023 <br />MOTION: Mr. Burnett moved to approve the minutes of the January 11, 2023, as <br />presented. Motion was seconded by Mr. Bakalla. Motion carried <br />unanimously by voice vote 7-0. <br />6. Disclosure of Ex Parte Communications <br />No disclosures of ex parte communications were made. <br />7. Conditional Use Applications <br />A. CU 22-16. 232-234 SR 436 - Conditional Use Extension Request <br />Staff Presentation: Planner II Antonia DeJesus presented a request to extend a conditional use <br />which was previously approved for a package liquor store at 232-234 SR 436. Ms. DeJesus stated <br />that staff recommends that case number CU 22-16 be approved with staff's conditions, based <br />upon the staff report and the testimony and evidence presented, that the request meets the <br />applicable provisions of the Unified Land Development Regulations and is consistent with the <br />Comprehensive Plan as per the written findings contained within the staff report. The conditions <br />of approval are as follows: <br />1. The conditional use shall be limited to the location of 232-234 SR 436. <br />2. All sales of alcoholic beverages shall be for only off-site consumption. <br />Consumption of alcoholic beverages on-site is prohibited. <br />3. The hours of sale shall comply with the operation and closing procedures outlined <br />in Section 10-2 and Section 10-3 of the City of Casselberry's Code of Ordinances. <br />4. Any interior or exterior alterations, including signage, shall be appropriately <br />permitted through the City's Building Division to ensure compliance with the Florida <br />Building Code and Fire Prevention Code. <br />5. The business shall comply and remain in compliance with all City, County, and <br />State requirements. <br />6. There shall be no outside display or storage of goods, materials, services, or <br />vehicles. <br />7. The conditional use shall commence within 12 months of the approval. <br />8. The conditional use shall expire if the use is discontinued for more than 90 days. <br />9. All of the above conditions shall be fully and faithfully executed, or the conditional <br />use shall become null and void. <br />Discussion: Discussion ensued, and the applicant, Paula Markovitz of Mount Dora, Florida, <br />came forward and stated they were looking for the extension due to the uncertainty with BJ's and <br />they are currently working with the landlord. Ms. Markovitz advised they were requesting a twelve- <br />month extension. <br />Audience Participation: No one came forward to address this item. <br />
