Orange Ave., Ste. 2000 <br />Orlando, FL 32801 <br />Parcel Id: 34-21-30-525-0000-2690 <br />GRANT MALOY, SEMINOLE COUNTY <br />CLERK OF CIRCUIT COURT & COMPTROLLER <br />CFN# 2023034047 Bk:10422 Pg:734-741(8Pgs) <br />REC: 04/14/2023 8:13:28 AM by hdevore <br />RECORDING FEES $69.50 <br />DEED TAX $0.70 <br />UTILITY EASEMENT AGREEMENT <br />THIS UTILITY EASEMENT AGREEMENT is made and entered into this .7"' <br />day of 20 by and between BRIAN PETRASKO and CHERYL <br />PETRASKO, husband and wife, whose address is 8739 Harbor View Drive, Orlando, FL 32817 <br />("Grantors") and the CITY OF CASSELBERRY, FLORIDA, a municipal corporation <br />("Grantee") whose address is 95 Triplet Lake Drive, Casselberry, FL 32707. <br />WITNESSETH: <br />WHEREAS, Grantors are the owners of that certain real property located in Casselberry, <br />Seminole County, Florida, more particularly described as set forth on Exhibit "A" attached <br />hereto and incorporated herein by this reference (the "Property"); and <br />WHEREAS, Grantors desire to grant and convey unto Grantee a non-exclusive public <br />utility easement to, over, under, upon, across and through that certain portion of the Property <br />which is described on Exhibit "B" attached hereto (the "Easement Area"), for the construction, <br />installation, operation, maintenance and repair by Grantee, or its employees, agents or designees, <br />of public utility lines, mains, pipes, pumps, valves, wires, structures, electrical controls, cables <br />and similar appurtenances (all of which are referred to as the "Utilities"). <br />NOW, THEREFORE, for and in consideration of the mutual covenants and agreements <br />contained herein and other good and valuable consideration, the receipt and sufficiency of which <br />are hereby acknowledged, Grantors and Grantee hereby agree as follows: <br />1. Recitals. The foregoing recitals are true and correct and are incorporated herein by this <br />reference. <br />2. Grant of Easement by Grantors. Grantors do hereby create, grant, convey and declare to <br />exist a non-exclusive easement to, over, under, upon, across and through the Easement Area for <br />the purpose of construction, installation, operation, maintenance and repair of the Utilities. <br />3. Incidental Rights. The easement hereby created and granted includes the creation of all <br />incidental rights reasonably necessary for the use and enjoyment of the Easement Area for its <br />intended purposes, including, specifically, the right of entry for purposes of construction, <br />installation, operation, maintenance and repair of any Utilities located within the Easement Area. <br />
