RESOLUTION 23-3.555 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING A UTILITY EASEMENT <br />AGREEMENT WITH BRIAN PETRASKO AND CHERYL PETRASKO ON <br />PARCEL ID: 34-21-30-525-0000-2690 (2337 ANTILLES DRIVE); <br />PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE <br />DATE. <br />WHEREAS, the City owns public utilities located on Parcel ID: 34-21-30-525-0000-2690 <br />(2337 Antilles Drive) which are not currently within an approved utility casement; and <br />WHEREAS, the property owners, Brian Petrasko and Cheryl Petrasko have agreed to grant <br />a utility easement over a portion of the property for the necessary construction, installation, <br />operation, maintenance, and repair of public utilities; and <br />WHEREAS, Public Works & Utilities Department staff has reviewed the Utility Easement <br />Agreement with Brian Petrasko and Cheryl Petrasko and finds it favorable to meet the needs of the <br />City. <br />NOW THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY <br />OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves the Utility <br />Easement Agreement with Brian Petrasko and Cheryl Petrasko on Parcel ID: 34-21-30-525-0000- <br />2690 (2337 Antilles Drive), attached hereto, and authorizes the Mayor to execute said document on <br />behalf of the City. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />SECTION IV.
