City Council <br />December 18, 1989 <br />Chairman Miller asked if there was any audience input with reference to <br />SP -89-01 and SPR -89-06, Newport Colony Apartments Final Plat and Site <br />Plan. The following individuals came forward: <br />1. Mr. Jim Bartow, Vice -President of the Cassel Creek Homeowners Asso- <br />ciation, 2567 Derbyshire Circle, said he wanted to be certain that Cassel <br />Creek Phase I is considered with this project, they want access out the <br />back of the project. The Declarations, Covenants and Restrictions, <br />Article I, Section 2, do not include Cassel Creek Phase I as a cross access <br />party and they want to be included. They also want to be included in <br />Article I, Section 5 with respect to cross access, as a resident of this <br />community, not just a satellite. They also want to be permitted to buy <br />a key for the access gates and be a part of the amenities. Cassel Creek <br />is comprised of 20 families with a potential of 40 families. <br />2. Ms. Betty Noise, Representative of the Forest Brook Homeowners, <br />asked that the parking lot improvements not be constructed until the Park <br />site is completed. Mr. Campbell said a majority of the Park improvements <br />shall be concluded before the parking lot commences construction, this does <br />not include scarification, land clearing, etc. Mayor Dennison said the Parks <br />Director should be the one who makes the final determination. <br />SP -89-01 and SPR -89-06, Newport Colony Apartments Final Plat and Site <br />Plan will be considered on the Regular Agenda. <br />Chairman Miller reopened the Public Hearings. <br />IV. Second Reading of Ordinance 650 - Amending Ordinance 396 (Newport <br />Colony re Derbyshire Improvements) <br />MOTION: Mr. Henson moved, Mrs. Percle seconded, <br />and motion carried unanimously to read <br />Notice of Public Hearing relative to Ordi- <br />nance 650. <br />(20) <br />
