CE -22-000398 123 Triplet Lake Dr. <br />• City Code 1-4.3.a: No Building Permit <br />• City Code 3-10.3.c.5.c.I & 2 Outdoor/open air storage — Residential <br />Supervisor Acevedo advised that this case was not in compliance and fines should be imposed. <br />NEW CASES <br />CE -22-000683 3405 S US HWY 17/92 <br />• 3-16.3.c.3.b Window sign requirements. <br />Supervisor Acevedo advised Officer Andreone will testify on his observations from when this case was <br />first observed and Ms. Acevedo was the current code officer, per Mr. Van Orden's request. <br />Officer Andreone gave testimony that the property was reinspected and found to remain in violation on <br />November 14, 2022. The City requested a correction date of December 01, 2022. If no compliance by <br />December 01, 2022, then a fine of $250.00 per day should then be imposed for each day of non-compliance <br />thereafter. The City requests a subsequent hearing date of December 15, 2022, to determine compliance. <br />The Special Magistrate asked if there was anyone present to speak to this case, the business owner was <br />present. <br />Paul Van Ordan, 3405 S US HWY 17/92, owner of Crumbl Cookies gave testimony and advised that behind <br />the graphics is a changing station, lockers for employees and a bathroom. They requested several times <br />what could be done and what the eyeglass store did is what Crumbl was told they could not do. Mr. Van <br />Orden stated they wanted to bring Crumbl to Casselberry, but the Code officer was nothing but a bully and <br />has to file trespass papers. Mr. Van spoke about ten items to make the violation appropriate, such as date <br />and time and time was not on there. <br />Ms. Acevedo advised that she did not receive a records request and Mr. Van Orden had spoken with City <br />planning about other options, which have been clearly stated to him. The Special Magistrate raised <br />questions about the notice and asked for information on that. <br />Jennifer Nix, Assistant City Attorney for City of Casselberry advised that it was the impression that Mr. <br />Van Orden was speaking about citation issuance, which this is not. Discussion. <br />The Special Magistrate found that CE -22-000683, located at 3405 S US HWY 17-92 was in violation of <br />the City Code Sections as listed on the notice of code violation, based on testimony and evidence provided <br />by the Code Enforcement Officer. It was ordered that the respondent shall cure the violations by 1:00 P.M. <br />December 01, 2022. If there is no compliance by December 01, 2022, then a fine of $250.00 per day will <br />be imposed for each day the property remains in non-compliance. A subsequent hearing will be held on <br />December 15, 2022, to determine if compliance has been achieved. <br />CE -22-000690 905 SR 436 <br />• City Code 3-16.10.a No sign permit -Larger than 6 sq ft <br />• City Code 3-10.3.c.5.b Outdoor/open air storage — Commercial or industrial <br />Officer Andreone gave testimony that the property was reinspected and found to remain in violation on <br />November 14, 2022. The City requested a correction date of December 12, 2022. If no compliance by <br />December 12, 2022, then a fine of $100.00 per day should then be imposed for each day of non-compliance <br />thereafter. The City requests a subsequent hearing date of December 15, 2022, to determine compliance. <br />The Special Magistrate asked if there was anyone present to speak to this case, a representative was present. <br />2 <br />
