Ms. Tran did not think she needed a permit to do work on the <br />garage, Ms. Tran continued. <br />The Special Magistrate made a ruling for case 22-000398, this cause came on for Hearing before the Code <br />Enforcement Special Magistrate on September 15, 2022, after due notice to the Respondent(s), , having heard <br />testimony and received evidence, considered stipulations, and heard argument(s), thereupon issues its Findings <br />of Fact, Conclusions of Law and Order, as follows: the City and Respondent presented their cases for the property <br />located at 123 Triplet Lake Dr, Casselberry, FL. The respondent was in violation for City Code Section 1-4.3 a, <br />No Building permit. Corrective action is to Comply and obtain all necessary permits. Second violation City Code <br />Section 3-10.3.c.5.c.1&2, Outdoor/open air storage — Residential. <br />Corrective action is to remove all non -permitted outdoor storage and put in acceptable storage areas. These <br />corrections shall take place by 1 PM, November 14, 2022, if the correction does not take place a $250 per day <br />fine shall be imposed for each day the property violations continue past the above -stated date. If the Code <br />Enforcement Officer finds that the correction has not been made, a hearing will be held on November 17, 2022, <br />at 6:30 p.m., at Casselberry City Hall. <br />SUBSEQUENT CASES <br />CE -22-000176 140 Sunnytown Rd. -Not in compliance <br />Officer Acevedo updated the Special Magistrate on this case and advised that the property was not in <br />compliance. <br />Hugh Hagin, 140 Sunnytown Rd. advised that he had some trouble getting the tenant to vacate, they have <br />been evicted and no one is living in the home. Mr. Hagin is working with the builder to design the house <br />before the existing house can be demolished. <br />Phillipe Lopez, 140 Sunnytown Rd. contractor advised that the demolish permit was pulled and they are <br />working on plans. <br />The Special Magistrate made a ruling in case 22-000176, 140 Sunnytown Rd. This case came on for hearing <br />before the previous Special Magistrate on June 16, 2022, after due notice to the Respondents, and the Board <br />heard testimony under oath, received evidence, and issued its findings of fact and conclusion of law and order, <br />which was furnished to Respondents. Said Order required Respondents to bring the property into compliance <br />on or before July 15, 2022 <br />At a subsequent hearing on September 15, 2022, the Magistrate heard testimony and considered evidence that <br />the Respondents have not complied with the Order imposed June 16, 2022 Now therefore, it is hereby <br />Ordered that Respondents pay to the City of Casselberry a fine in the amount of $150 per day for each and <br />every day the violation exists (plus any preparation/administrative fees), for each and every day the violation <br />exists and continues to exist. <br />CE -22-000339 400 SR 436- Not in compliance <br />Officer Acevedo updated the Special Magistrate on this case and advised that the property was not in <br />compliance. The Special Magistrate asked if there was anyone present related to this case. There was no <br />one present. <br />The Special Magistrate made a ruling in case 22-000339, 400 SR 436. This case came on for hearing before <br />the previous Special Magistrate on June 16, 2022, after due notice to the Respondents, and the Board heard <br />testimony under oath, received evidence, and issued its findings of fact and conclusion of law and order, <br />which was furnished to Respondents. Said Order required Respondents to bring the property into compliance <br />on or before July 15, 2022 <br />2 <br />
