and/or Table 3-13.7.(C2) is desirable to provide for specific flexible requirements for landscape <br />buffers within parks, including flexibility to include sidewalks or shared use paths within <br />landscape buffers, subject to Planning and Zoning Commission approval; and <br />WHEREAS, the City also finds that Code language in ULDR 3-13.7.C.2.g regarding <br />exceptions for accessways through landscape strips along public right-of-way should be revised to <br />include an exception for active transportation modes such as sidewalks and shared use paths, in <br />addition to automobile traffic. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY <br />OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. Legislative Findings. The above recitals are hereby adopted as the <br />legislative findings of the City Commission. The City Commission finds and determines that there <br />is competent substantial evidence to support the findings and determinations made in this <br />resolution. <br />SECTION II. Recognizing Legislation in Progress. The City of Casselberry hereby <br />recognizes and confirms that legislation is in progress to adopt amendments to the ULDR Section <br />3-13.7, including specifically Table 3-13.7.(C1) and/or Table 3-13.7.(C2) to provide flexibility in <br />the buffer requirements for Recreation and Open Space zoned property to provide for connectivity <br />via active transportation modes, as well as ULDR Section 3-13.7.C.2.g regarding accessways to <br />also permit access by active transportation modes. Staff is directed not to issue any permits, <br />development orders or other land use activity within the City of Casselberry which would require <br />buffer yards or accessways in conflict with the pending amendments. <br />SECTION III. Conflicts. All Resolutions, or parts of Resolutions in conflict with any <br />provisions of this Resolution are hereby repealed to the extent of the conflict. <br />SECTION IV. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />SECTION V. Effective Date. This Resolution shall become effective immediately after <br />passage and adoption. <br />PASSED AND ADOPTED this Iday of , A.D. 2023. <br />ATTEST: <br />onna G.
