FILE NUM 200 995131 <br />OR BOOK 04638 PAGE 172 <br />method of enforcing any codes and ordinances in force in the City where a pending <br />or repeated violation continues to exist. <br />Section 2-148 Membership; appointment and removal of members; term of office; <br />counsel. <br />(a) Membership; compensation of members. There is created a Code <br />Enforcement Board of the City, which shall consist of seven members to be appointed <br />by the City Commission. All members shall be residents of the City and shall serve <br />without compensation. <br />(b) Composition. Appointments shall be made on the basis of experience <br />and interest in the subject matter jurisdiction of the Code Enforcement Board, in the <br />sole discretion of the City Commission. The membership of the Board shall, <br />whenever possible, include an architect, a businessperson, an engineer, a general <br />contractor, a subcontractor and a Realtor. <br />(c) Term of Office. Each appointment shall be made for a term of three <br />years. A member may be reappointed upon approval of the City Commission. <br />(d) Removal of members; filling of vacancies. Members of the Board may <br />be removed from office by the City Commission for good cause upon written charges <br />and after public hearing. Any member who fails to attend two out of three <br />consecutive meetings without cause and without prior approval of the chairman of the <br />Board shall automatically forfeit his appointment, and the City Commission shall <br />promptly fill the vacancy. Vacancies shall be filled by appointment by the City <br />Commission for the unexpired term affected. <br />(e) Counsel. The City Attorney is designated as counsel to the Board, and <br />shall assist the Board in the conduct of its hearings. <br />Section 2-149 Jurisdiction. <br />The Code Enforcement Board shall have the jurisdiction and authority to hear <br />and decide alleged violations of any ordinances or codes in force in the City. The <br />jurisdiction of the Board shall not be exclusive. Any alleged violation of any codes <br />or ordinances may be pursued by additional or supplemental means, including <br />appropriate remedy in court, at the option of the administrative official whose <br />responsibility it is to enforce that respective code or ordinances. <br />Section 2-150 Enforcement procedure. <br />Ordinance No. 9.2 <br />Page 2 of 9 <br />
