HEIMAN and INIDIA VELEZ, (hereinafter referred <br />to as "Owners") whose address is 503 Wilshire Drive, Casselberry, FL 32707. <br />WHEREAS, Owners presently own that certain property generally described as Lot 4, <br />Block 8, Heftler Homes Orlando Section One, according to the plat, as recorded in Plat Book 13, <br />Pages 5-6 in the public records of Seminole County, Florida, having a street address of 503 <br />Wilshire Drive, in Seminole County, Florida (the "Property"), which Property is being serviced by <br />the City's water and sewer facilities; and <br />WHEREAS, the City has a utility easement located on the Property which services the <br />Property as well as other properties; and <br />WHEREAS, Owners own a shed which encroaches into a 7' utility easement as recorded <br />in Plat Book 13, Pages 5-6, Public Records of Seminole County, Florida (hereinafter "Easement"); <br />and <br />WHEREAS, the parties hereto wish to enter into this Agreement to allow the shed to <br />encroach into the City's Easement, subject to the conditions of this Agreement. <br />NOW, THEREFORE, in consideration of the terms and conditions set forth herein, the <br />parties agree as follows: <br />1. The "whereas" clauses set forth above are true and accurate and are hereby <br />incorporated herein. <br />2. The City hereby authorizes and allows Owners' shed to encroach into the Easement, <br />but only to the extent as approved in Development Review Committee (DRC) on August 18, 2022, <br />and as shown in Exhibit A, attached, which is a certified sketch of the encroachment. <br />3. Owners agree to ensure that the Owners and the shed do not damage the utilities <br />located in the Easement. In the event Owners or the shed do in fact damage said utilities, Owners <br />
