RESOLUTION 22-3330 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING <br />EXECUTION OF AN ENCROACHMENT LICENSE AGREEMENT TO <br />ALLOW AN ACCESSORY STRUCTURE IN A 7 FOOT UTILITY <br />EASEMENT, AS RECORDED IN PLAT BOOK 13, PAGES 5-6 IN THE <br />PUBLIC RECORDS OF SEMINOLE COUNTY, FLORIDA; PROVIDING <br />FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. <br />WHEREAS, on July 7, 2022, a site plan review application was submitted with the City <br />of Casselberry, Florida for an accessory structure to encroach into a 7 foot Utility Easement on <br />Lot 4, Block 8, Heftler Homes Orlando Section One, as recorded in Plat Book 13, Pages 5-6 in the <br />Public Records of Seminole County, Florida; and <br />WHEREAS, the City Commission finds that approving an encroachment into the recorded <br />easement will not present a detriment to either the City of Casselberry, Florida, or the public. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA: <br />SECTION I. The City Commission of the City of Casselberry hereby approves the <br />Encroachment License Agreement, attached herewith, allowing the encroachment of an accessory <br />structure in the 7 foot Utility Easement on Lot 4, Block 8, Heftler Homes Orlando Section One, as <br />recorded in Plat Book 13, Pages 5-6 in the Public Records of Seminole County, Florida, and <br />authorizes the Mayor to execute said document on behalf of the City Commission. <br />SECTION II. CONFLICTS. All Resolutions or parts of Resolutions in conflict with <br />any of the provisions of this Resolution are hereby repealed. <br />SECTION III. SEVERABILITY. If any Section or portion of a Section of this <br />Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or <br />impair the validity, force, or effect of any other Section or part of this Resolution. <br />SECTION IV. EFFECTIVE DATE.
