Ordinance 22-1576 — Amending, Chapter 34, Emergency Services, Article II, Alarm <br />Systems, Division 2, Security Alarms <br />The City Clerk read Ordinance 22-1576 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING CHAPTER 34, <br />EMERGENCY SERVICES, ARTICLE II, ALARM SYSTEMS, DIVISION 2, SECURITY <br />ALARMS, OF THE CODE OF ORDINANCES TO ADD SECTIONS INCLUDING WAIVERS <br />AND EXEMPTIONS AND AN APPEAL PROCESS, AND TO CLARIFY EXISTING CODE; <br />AMENDING CHAPTER 2, ADMINISTRATION, ARTICLE IV, BOARDS, COMMITTEES AND <br />COMMISSIONS, DIVISION 2, CODE ENFORCEMENT BOARD, SECTION 2-149 TO PROVIDE <br />THE SPECIAL MAGISTRATE WITH JURISDICTION OVER THE APPEALS; AMENDING <br />ARTICLE V CODE ENFORCEMENT CITATIONS, SECTION 2-210 TO INCLUDE A FALSE <br />ALARM VIOLATION; PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY, <br />AND EFFECTIVE DATE." <br />Staff Presentation: Deputy Police Chief Derrick Becton stated Ordinance 22-1576 provides for amending <br />the City of Casselberry Code of Ordinances, Chapter 34, Article II, Division 2, Security Alarms to create <br />definitions, clarify existing code, add an appeal process, and provide the Special Magistrate with <br />jurisdiction over false alarrn fee appeals. He then gave an overview of the City's current regulations related <br />to security alai -ins and provided detail on some of the changes being proposed which included updating and <br />adding some definitions to allow for less confusion and to clear up ambiguities; creation of exceptions to <br />allow the Alarm Coordinator to waive late response fees or exempt false alarms in certain circumstances; <br />revision of language requiring malfunctioning alarms to be repaired; addition of an appeals process before <br />the Code Enforcement Special Magistrate with a Code Enforcement Officer presenting the City's case; and <br />the ability to appeal a Special Magistrate decision in the courts. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Police Chief recommended approval of Ordinance 22-1576 <br />o first reading. <br />Audience Participation: No one came forward to address Ordinance 22-1576. <br />City Attorney Reisclhmann noted for the record that there was one small typographical error in the ordinance <br />which would be corrected between first and second reading. <br />MOTION: Vice Mayor Aramendia moved to approve Ordinance 22-1576 on first <br />reading, as presented. Motion was seconded by Commissioner Busch. Motion <br />carried unanimously by voice vote 5-0. <br />
