The intensity and/or density of a Major Thoroughfare Mixed -Use shall be subject to the <br />availability of services and facilities to support the development. <br />J. Other uses may be permitted as designated in the Unified Land Development Regulations-, <br />which are compatible with and do not adversely affect the character of the area to be reviewed <br />as a conditional use. <br />K. Properties in this category shall display physical and functional integration of project <br />components with adjacent uses in order to reduce external traffic trips and provide greater <br />access. <br />1. Land uses that are lawful uses at the time of <br />the effective date of this Ordinance shall remain legally conforming uses and shall be exempt from <br />this Ordinance. Despite the vesting of existing uses, in an abundance of caution, City staff is <br />directed to provide Bert J. Harris Act notices to certain select businesses at City staffs discretion <br />to ensure that all businesses are aware of this Ordinance. <br />SECTION III. CONFLICTS. All Ordinances or parts of Ordinances in conflict with any <br />of the provisions of this Ordinance are hereby repealed to the extent of the conflict. <br />SECTION IV. SEVERABILITY. If any Section or portion of a Section of this Ordinance <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Ordinance. <br />SECTION V. EFFECTIVE DATE. This Ordinance shall become effective thirty-one <br />(3 1) days after the State Land Planning Agency notifies the City of Casselberry of the completion <br />of the plan amendment package. If challenged within thirty (30) days after adoption, this <br />Ordinance shall not become effective until the State Land Planning Agency or the Administration <br />Commission, respectively, issues a final order determining the adopted amendment contained in <br />this Ordinance is in compliance. <br />Ordinance 22-1572 <br />Page 4 <br />
