ORDINANCE NO. 22-1576 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, <br />AMENDING CHAPTER 34, EMERGENCY SERVICES, ARTICLE II, <br />ALARM SYSTEMS, DIVISION 2, SECURITY ALARMS, OF THE CODE OF <br />ORDINANCES TO ADD SECTIONS INCLUDING WAIVERS AND <br />EXEMPTIONS AND AN APPEAL PROCESS, AND TO CLARIFY EXISTING <br />CODE; AMENDING CHAPTER 2, ADMINISTRATION, ARTICLE IV, <br />BOARDS, COMMITTEES AND COMMISSIONS, DIVISION 2, CODE <br />ENFORCEMENT BOARD, SECTION 2-149 TO PROVIDE THE SPECIAL <br />MAGISTRATE WITH JURISDICTION OVER THE APPEALS; AMENDING <br />ARTICLE V, CODE ENFORCEMENT CITATIONS, SECTION 2-210 TO <br />INCLUDE A FALSE ALARM VIOLATION; PROVIDING FOR <br />CODIFICATION, CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, the City desires to provide an appeal from the assessment of a false alarm fine, <br />and to provide that the appeal is to the City's Special Magistrate; and <br />WHEREAS, the False Alarm section could benefit from an exemption and waiver provision, <br />and the City desires to establish a civil citation classification for a False Alarm. <br />WHEREAS, words with double underlined type shall constitute additions to the original <br />text and strike thfough type shall constitute deletions to the original text, and asterisks (* * *) <br />indicate that text shall remain unchanged from the language existing prior to adoption of this <br />Ordinance. <br />NOW, THEREFORE, BE IT ENACTED BY THE COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION 1. Chapter 34, Emergency Services, Article II, Alarm Systems, DIVISION 2. <br />SECURITY ALARMS, of the Code of Ordinances of the City of Casselberry, Florida, are amended <br />as follows: <br />34-36. Purpose <br />The purpose of this chapter is to encourage security Alarm Users and alarm <br />businesses (including, but not limited to, sales, installation, and/or monitorinl to <br />maintain the operational reliability and the proper use of alarm systems so as to <br />limit unnecessary police responses to false alarm and alarm malfunctions. <br />34-3.7.
