ORDINANCE 22-1577 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING <br />CHAPTER 86, TO ADD ARTICLE VIII, SECTIONS 86-356 THROUGH 86-376, <br />IMPLEMENTING INCREASED LEGAL AUTHORITY OVER ILLICIT <br />DISCHARGES AND CONNECTIONS TO THE CITY'S MUNICIPAL SEPARATE <br />STORM SEWER SYSTEM, CONFORMING STATE AND NATIONAL <br />REQUIREMENTS FOR POLLUTANT DISCHARGE ELIMINATION SYSTEM <br />PERMITS; AMENDING SECTION 2-210, SCHEDULE OF VIOLATIONS TO <br />INCLUDE A VIOLATION OF SECTIONS 86-356 THROUGH 86-376; PROVIDING <br />FOR CODIFICATION, CONFLICTS, SEVERABILITY AND AN EFFECTIVE <br />DATE. <br />WHEREAS, the Florida Legislature has declared that it is in the public interest to promote effective <br />and efficient regulation of the discharge of pollutants into waters of the state, and <br />WHEREAS, the City of Casselberry is authorized by the Florida Constitution and the provisions <br />of Florida Statues chapters 163 and 403 to establish and administer programs for stormwater management, <br />including the control of pollution discharged to the City's storm sewer system, and <br />WHEREAS, the contribution of pollutants through discharges from storm sewer systems has a <br />significant impact on receiving waters in the City; and improperly treated discharges from industrial or <br />commercial activities, interconnected municipal separate storm sewer systems, illicit discharges and <br />discharges from spilling, dumping or disposal of material other than stormwater to the municipal storm <br />sewer system of the City adversely affects the quality of water receiving such discharges, and <br />WHEREAS, Chapter 376 of Florida Statues, Sec. 403.0885, Fla. Stat., and applicable provisions <br />under Sections 62-40, 62-330, 62-431, and 62-624, Florida Administrative Code, provide for state <br />establishment and implementation of the Federal National Pollutant Discharge Elimination System (NPDES) <br />program in accordance with Section 402 of the Clean Water Act; and <br />WHEREAS, the City Commission of the City of Casselberry, Florida, hereby finds this Ordinance <br />to be in the best interest of the public health, safety and welfare of the citizens of Casselberry and the general <br />public. <br />Illicit Discharge and Connections Ordinance <br />
