In the 1990's the United States Environmental Protection Agency <br />(EPA) developed a model ordinance for illicit discharge for local governments to use as a template and to <br />assist with the needed updates while satisfying the permit requirements of the NPDES. City Staff and the <br />City Attorney have created proposed Ordinance 22-1577 in order to update the City's Code based on the <br />EPA's model ordinance but have drafted it to be specific to the City of Casselberry. It outlines examples <br />of what types of pollutants and connections would constitute violations, provides exemption details, system <br />user responsibilities and timeline for response, and enforcement details for Code compliance. This <br />ordinance will allow the City to have increased legal authority related to illicit discharges and connections <br />to the City of Casselberry's separate storm sewer system and through the regulation of non-stormwater <br />discharge, the City will be able to provide for better health, safety and general welfare to the citizens of the <br />City of Casselberry. With implementation of the ordinance the City will also have successfully satisfied <br />its requirements as it relates to the City's NPDES permit. In response to a question from the City <br />Commission, Mr. Cooper explained that many of the surrounding municipalities and jurisdictions have <br />similar ordinances in place already, but there was currently an absence of this type of regulation in the <br />City's Code of Ordinances. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Public Works & Utilities Director recommended approval <br />of Ordinance 22-1577 on first reading. <br />Audience Participation: No one came forward to address Ordinance 22-1577. <br />MOTION: Commissioner Busch moved to approve Ordinance 22-1577 on first reading, <br />as presented. Motion was seconded by Vice Mayor Aramendia. Motion <br />carried unanimously by voice vote 5-0. <br />B. Ordinance 22-1578 — Amendinp, the Future Land Use Map Designation for the <br />Property Located at 1398 State Road 436 (LPA 22-08) <br />The City Clerk read Ordinance 22-1578 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE CITY OF <br />CASSELBERRY COMPREHENSIVE PLAN BY PROVIDING FOR A CHANGE OF THE <br />FUTURE LAND USE DESIGNATION FROM LOW INTENSITY NON-RESIDENTIAL/MEDIUM <br />DENSITY RESIDENTIAL TO MAJOR THOROUGHFARE MIXED-USE FOR ONE PARCEL, <br />TOTALING APPROXIMATELY 3.94 ACRES, LOCATED AT 1398 STATE ROAD 436, AS <br />DESCRIBED IN SECTION I OF THIS ORDINANCE; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND AN EFFECTIVE DATE." <br />Staff Presentation: Chief Planner Christina Hyson stated Ordinance 22-1578 provides for amending the <br />Future Land Use Map (FLUM) designation from Low Intensity Non-Residential/Medium Density <br />Residential (LINR/MDR) to Major Thoroughfare Mixed -Use (MTMU) for one (1) parcel located at 1398 <br />State Road 436. The subject property is approximately 3.94 acres in size and was developed in 1974 with <br />a two-story building; however, the site has been vacant with no active businesses since 2008. The applicant <br />purchased the property earlier this year with the hope of redeveloping it with multi -family housing. <br />
