CE -22-000405 421 Marigold Rd. <br />• City code 3-10.3.c.1 Overgrowth, weeds, trash and debris <br />Officer McDonald gave testimony that the property was reinspected and found to remain in violation on <br />July 18, 2022. The City requested a correction date of August 04, 2022. If no compliance by August 04, <br />2022 then a fine of $50.00 per day should then be imposed for each day of non-compliance thereafter. <br />The City requests a subsequent hearing date of September 15, 2022 to determine compliance. The Special <br />Magistrate asked if there was anyone present to speak to this case, there was no one present. <br />The Special Magistrate made a finding that CE -22-000405, located at 421 Marigold Rd., was in violation <br />of the City Code Sections as listed on the notice of code violation, based on testimony and evidence <br />provided by the Code Enforcement Officer. It was ordered that the respondent shall cure the violations by <br />1:00 P.M. August 04, 2022. If there is no compliance by August 04, 2022, then a fine of $100.00 per day <br />will be imposed for each day the property remains in non-compliance. A subsequent hearing will be held <br />on September 15, 2022 to determine if compliance has been achieved. <br />SUBSEQUENT CASES <br />CE -21-000800 511 Jasmine Rd. <br />• City Code 3-10.3.c.1 Dead tree(s) <br />Officer McDonald updated the Special Magistrate on this case. Supervisor Acevedo advised that the <br />respondent was present and is Spanish speaking, she did not bring an interpreter. The Special Magistrate <br />advised the City to show the current pictures to the respondent. <br />Maria Angeles gave testimony and asked for more time, due to lack of funds. The Special Magistrate <br />advised she would be open to tabling but would not do so unless the City requested it. Ms. Acevedo <br />advised she would prefer a finding. <br />The Special Magistrate advised that in addition to respondent's and Officer McDonald's testimony, she <br />also had affidavit of non-compliance from Officer McDonald, indicating the property was not in <br />compliance.
