Office Andreone gave testimony that the property was reinspected and found to remain in violation on <br />July 18, 2022. The City requested a correction date of August 20, 2022. If no compliance by August 20, <br />2022 then a fine of $250.00 per day should then be imposed for each day of non-compliance thereafter. <br />The City requests a subsequent hearing date of September 22, 2022 (actual hearing date September 15, <br />2022) to determine compliance. <br />Randy Lamb, Building Official for City of Casselberry gave testimony. Mr. Lamb was brought into this <br />in April (2022) by the Fire Marshal due to work being done without a permit. There was in fact work <br />done with no permits. There was remodeling, interior alterations, and ongoing construction work, much of <br />which was in violation of Building Code. <br />The Special Magistrate asked if Mr. Lamb could give some examples of what he saw being done. Mr. <br />Lamb stated there were electrical installations, electrical panels with no engineering, plumbing, spaces <br />remodels to something like an apartment, with complete bathroom. Plumbing was not code compliant, <br />there was open electric panels that presented a life safety hazard. Demolition on the second floor of <br />building 400 and there was an asbestos evaluation that was alarming. Mr. Lamb continued. <br />John Biemiller, contractor representing property owner, contractor license number CGC 058834. Mr. <br />Biemiller was brought into this project three weeks ago and got a general view of what had been done and <br />informed that an architect was hired. It took some time to get architectural plans. There was now a full set <br />of plans for every unit that permits were not pulled for. The Special Magistrate asked if a permit was <br />pulled for each unit. Mr. Biemiller stated yes and was working on some issues with Mr. Lamb. There is <br />also an asbestos report showing the asbestos at less than 1%. Mr. Biemiller continued. <br />Mr. Lamb stated in chapter 553 of the Florida Building code, when a permit is pulled there is 180 days to <br />have an approved inspection, if there is an approved inspection the permit stays active. <br />The Special Magistrate made a finding that CE -22-000339, located at 400 SR 436., was in violation of the <br />City Code Sections as listed on the notice of code violation, based on testimony and evidence provided by <br />the Code Enforcement Officer. It was ordered that the respondent shall cure the violations by 1:00 P.M. <br />August 20, 2022. If there is no compliance by August 20, 2022 then a fine of $250.00 per day will be <br />imposed for each day the property remains in non-compliance. A subsequent hearing will be held on <br />September 15, 2022 to determine if compliance has been achieved. <br />CE -22-000196 233 Wilshire Dr. <br />• City code 3-10.3.a.4 Roofs, gutters, down spouts maintenance. <br />Officer Andreone gave testimony that the property was reinspected and found to remain in violation on <br />July 18, 2022. The Special Magistrate asked if there was anyone <br />present to speak to this case, there was no one present. <br />The Special Magistrate made a finding that CE -22-000196, located at 233 Wilshire Dr., was in violation <br />of the City Code Sections as listed on the notice of code violation, based on testimony and evidence <br />provided by the Code Enforcement Officer. It was ordered that the respondent shall cure the violations by <br />1:00 P.M. September 19, 2022. If there is no compliance by September 19, 2022, then a fine of $100.00 <br />per day will be imposed for each day the property remains in non-compliance. A subsequent hearing will <br />be held on October 20, 2022 to determine if compliance has been achieved. <br />2� ': <br />
