WHEREAS, Section 252.38(3), Florida Statutes, provides authority for local <br />governments such as the City of Casselberry, to take actions in emergency <br />situations and to waive the procedures and formalities otherwise required of <br />political subdivisions by law pertaining to: <br />1. Performance of public work and taking whatever action is necessary to <br />ensure the health, safety, and welfare of the community; <br />2. Entering into contracts; <br />3. Incurring obligations; <br />4. Employment of permanent and temporary workers; <br />5. Utilization of volunteer workers; <br />6. Rental of equipment; <br />7. Acquisition and distribution, with or without compensation, of supplies, <br />materials and facilities; <br />8. Appropriation and expenditure of public funds; and <br />WHEREAS, pursuant to Florida Statutes § 252.46(2), the statutory authority for <br />the City's emergency rulemaking powers, the orders and rules adopted due to a <br />declared emergency, shall have the full force and effect of law after adoption and upon <br />filing with the Office of the City Clerk; and <br />WHEREAS, these emergency orders or rules may deviate from existing laws, <br />ordinances, and rules inconsistent with or in conflict with such emergency orders and <br />rules during the period of time the declared emergency exists; and <br />WHEREAS, the City Commission of the City of Casselberry desires to <br />exercise emergency management powers consistent with the emergency <br />management declarations of the Governor of the State of Florida, and other <br />municipalities within Seminole County, and Chapter 30 of the City Code. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA: <br />SECTION 1. The City Commission hereby confirms the decision of the City <br />Manager to declare a public state of weather emergency. Per City Code Section 30- <br />7(e), the public state of weather emergency commenced at 11:00 a.m. on Monday, <br />September 26, 2022; a copy of the City Manager's emergency declaration is attached to <br />this Resolution as Exhibit B. The City Commission authorizes the City Manager to <br />extend the public state of emergency in 7 day increments, as necessary, until <br />terminated by the City Manager or the City Commission. <br />2 <br />
